ADOH must reserve Tax Credits to a Project through a letter notifying the Applicant of the Tax Credit Reservation.
Failure to meet this timeline will result in rescission of the Tax Credit Reservation or negative points.
Failure to begin construction within 180 days of award shall result in rescission of the Tax Credit Reservation and may result in assessment of negative points.
If no construction lender is involved, evidence must be submitted within 180 days after the Credit Reservation is made that the equity partner has been admitted to the ownership entity and that an initial disbursement of funds has occurred.
Once a Tax Credit Reservation has been awarded, the following additional requirements will apply.

The developer and the Allocating Agency prior to the issuance of the initial Housing Credit Reservation Certificate/Binding Rate Agreement shall agree upon the amount of the Developer’s Fee.
The Ten Percent (10%) Cost Test due date will be twelve (12) months from the issuance of the Tax Credit Reservation Letter.To satisfy the Ten Percent (10%) Cost Test, the Owner must demonstrate it has incurred or expensed, by the deadline date stipulated in the Reservation letter, qualified costs in an amount that is at least ten percent (10%) of the reasonably expected basis in the Project (including land costs) at the close of the second calendar year.
In the event that ADOH requires a return of a Tax Credit Reservation, ADOH will give notice to the Applicant.
