Criminal investigatory record means a record which is not
Criminal investigatory record means a record which is not required by law to be made, maintained or kept on file that is held by a law enforcement agency which pertains to any criminal investigation or related civil enforcement proceeding.
Criminal investigatory record means a record which is not required by law, statute, rule, regulation, or directive, general operating procedure from the New Jersey Attorney General or from the law enforcement agency in which the record is sought, or general order of the New Jersey Attorney General or of the law enforcement agency in which the record is sought, to be made, maintained or kept on file that is held by a law enforcement agency which pertains to any criminal investigation or related civil enforcement proceeding. Notwithstanding anything contained herein to the contrary, this provision shall not be construed to allow any public agency to prohibit access to a record that was open for public inspection, examination, or copying, before any criminal investigation or related civil enforcement proceeding commenced.
