Data Privacy Claim definition

Data Privacy Claim means a Claim arising from (a) a Party’s failure to comply with the applicable data security and privacy laws as clarified by the roles, responsibilities and obligations set forth in the applicable Data Protection Terms or (b) Customer’s failure to comply with section 4.4 (Third-Party Providers) or Customer’s terms of use and privacy policy.
Data Privacy Claim means a Claim arising from: (A) either Party’s failure to comply with the Data Protection Obligations; or (B) Customer’s failure to comply with section 4.4 (Third Party Providers); or Customer’s terms of use and privacy policy.
Data Privacy Claim means a Claim arising from (a) a Party’s failure to comply with the applicable data security

Examples of Data Privacy Claim in a sentence

  • In the event of a Data Privacy Claim, both Parties agree to provide each other reasonable assistance in investigating, mitigating, and resolving such Data Privacy Claim.

  • Indemnifying Party will have no liability for any Data Privacy Claim to the extent such Claim arises from any act or omission of Indemnified Party that impedes or prevents Indemnifying Party’s ability to comply with applicable data security and privacy laws.

  • Data Privacy Laws means any state or national law or regulation protecting the privacy, confidentiality, or security of Personal Information.

  • The HIPAA Privacy Rule means the Standards for Privacy of Individually 10 Identifiable Health Information at 45 CFR Part 160 and Part 164, Subparts A and E.

  • Company Privacy Policy means each external or internal, past or present privacy policy of the Company, including any policy relating to (i) the privacy of users of the Company Products or of any Company Website, (ii) the collection, storage, disclosure, and transfer of any User Data or Personal Data, and (iii) any employee information.

  • HIPAA Privacy Rule as defined in 45 CFR Part 164, Subparts A and E.

  • Information Privacy Principles means the information privacy principles set out in the Privacy and Data Protection Act 2014 (Vic).

  • Privacy Statement means the rules determined by the Company in relation to, among other things, the collection and use of personal information;

  • Information Privacy and Security Laws means applicable Laws and legal requirements (and binding industry standards) concerning the use, ownership, maintenance, storage, collection, transfer, processing, controlling, privacy and/or security of Personal Information.

  • Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

  • Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;

  • Customer Account Information means personally identifiable information including Personal Data and Consumption Data. Customer Account Information also includes information received by the Company from the customer for purposes of participating in regulated utility programs, including, but not limited to bill pay assistance, shutoff protection, renewable energy, demand-side management, load management, or energy efficiency.

  • Customer Personal Data means the personal data contained within the Customer Data.

  • Privacy/Data Security Laws means all Laws governing the receipt, collection, use, storage, processing, sharing, security, disclosure, or transfer of Personal Information and any applicable Laws concerning requirements for website and mobile application privacy policies and practices, call or electronic monitoring or recording or any outbound communications (including outbound calling and text messaging, telemarketing, and e-mail marketing).

  • Privacy Shield means the European Union (EU) -U.S. and Switzerland – U.S. Privacy Shield frameworks.

  • Customer Information means any information contained on a customer’s application or other form and all nonpublic personal information about a customer that a Party receives from the other Party. Customer Information shall include, but not be limited to, name, address, telephone number, social security number, health information, and personal financial information (which may include a Masterworks user account number).

  • Data Provider means a Participant that is registered to provide information to GS1 South Africa for use through the Verified by GS1 Services.

  • Customer Data means any content, materials, data and information that Authorized Users enter into the production system of a Cloud Service or that Customer derives from its use of and stores in the Cloud Service (e.g. Customer-specific reports). Customer Data and its derivatives will not include SAP’s Confidential Information.

  • Account Information Service Provider means a payment service provider pursuing business activities as referred to in point (8) of Annex I;
