Examples of Deemed Date of Possession in a sentence
In case the Allottee fails to take possession within the time provided in para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.2 from the Deemed Date of Possession.
In case the delivery of physical possession of the Apartment is withheld by the Allottee on any grounds/reasons, the physical possession of the Apartment shall be deemed to have been taken by the Allottee on the Deemed Date of Possession as indicated in the Notice of Possession and morefully described in Clause 7.3 below.
For all purposes, such Deemed Date of Possession, irrespective of the actual date on which the Allottee/s take/s over the physical possession of the Apartment, will be construed as the Possession Date.
After the Deemed Date of Possession, the Promoter shall not be responsible for any damage caused to the Unit on account of delay on the part of the Allottee(s) in taking over possession and in such event the Allottee(s) shall have to take possession of the same on “as is where is basis”.
In case the delivery of physical possession of the Said Apartment and Said Parking Space, if any, is withheld by the Promoter on any grounds/reasons, the physical possession of the Said Apartment and Said Parking Space, if any, shall be deemed to have been taken by the Allottee on the Deemed Date of Possession as indicated in the Notice of Possession irrespective of the date when the Allottee takes physical possession of the Said Apartment and Said Parking Space, if any.
Each of the Allottee(s) shall also be required to pay the charges for maintenance and management of common-areas and facilities and applicable municipal rates & Taxes commencing from the Deemed Date of Possession in addition to the Guarding Charges, If any.
The Allottee(s) shall be liable to pay from the date of Deemed Date of Possession or date of actual possession, whichever is earlier, house-tax, property-tax, fire-fighting tax or any other fee, cess or tax as applicable under Applicable Law, as and when levied by any local body or authority and so long as the Unit of the Allottee(s) is not separately assessed to such taxes, fees or cess, the same shall be paid by the Allottee(s) in proportion to the Carpet Area of Unit.
The Allottee, after taking possession and/or from the Deemed Date of Possession, agree(s) to pay the maintenance charges,taxes etc as determined by the Promoter/Association of allottees.
In case the delivery of physical possession of the Said Apartment is withheld by the Promoter on any grounds/reasons, the physical possession of the Said Apartment shall be deemed to have been taken by the Allottee on the Deemed Date of Possession as indicated in the Notice of Possession irrespective of the date when the Allottee takes physical possession of the Said Apartment.
The Allottee, after taking possession and/or from the Deemed Date of Possession, agree(s) to pay the maintenance charges as determined by the Promoter/Association of allottees.
