DEHP Free. Covered Products shall mean Covered Products containing materials or other Accessible Components all of which are confirmed to contain less than or equal to 1,000 parts per million (“ppm”) of DEHP through laboratory chemical concentration testing, of a random selection of no less than .1% of the products in any order or shipment, by a NVLAP accredited U.S. laboratory.

DEHP Free. Products shall mean Products containing no more than 0.1 percent (1,000 parts per million) of the Listed Chemical when analyzed pursuant to Environmental Protection Agency testing methodologies 3580A and 8270C, or equivalent methodologies utilized by federal or state agencies for the purpose of determining the presence of the Listed Chemical in a given sample.

• This limited warranty is the only warranty made by Seller and can be amended only in writing signed by an Authorized Representative of Seller.

• The final civil penalty shall be waived in its entirety, however, if, no later than the Effective Date, an officer of Master Magnetics provides Englander with written certification that, as of the date of such certification and continuing into the future, Master Magnetics has met the DEHP Free standard specified above, such that all new Products manufactured, imported, distributed, sold and offered for sale in the United States by Master Magnetics after June 1, 2013, are DEHP Free.

• As of the Effective Date, and until January 1, 2017, Wellsco shall not sell or ship any Covered Product to a California vendor or retailer, or After January 1, 2017, Wellsco shall not distribute or otherwise sell any Covered Product unless it is DEHP Free and shall not sell any products that are not DEHP Free regardless of whether a Proposition 65 warning accompanies the product or not.

• Prior to purchase and acquisition of any Covered Product from any new vendor, Wellsco shall obtain a written confirmation and accompanying laboratory test result from the new vendor demonstrating compliance with the DEHP Free phthalate concentration standard in all materials comprising the Covered Product.
