Developer Improvement Account definition

Developer Improvement Account means the Account in the Project Fund established pursuant to Section 6.1 of this Indenture.
Developer Improvement Account means the construction fund account created under the Indenture, funded by Developer, and used to pay for portions of the acquisition, design, and construction of the Authorized Improvements.
Developer Improvement Account means the Account of such name established pursuant to Section 6.1.

Examples of Developer Improvement Account in a sentence

  • Disbursements from the Improvement Account and the Developer Improvement Account of the Project Fund to pay Costs shall be made by the Trustee upon receipt by the Trustee of a properly executed and completed Certificate for Payment.

  • All disbursements of funds from the Improvement Account and the Developer Improvement Account shall be disbursed in accordance with a Certificate for Payment; provided that all disbursements of funds pursuant to a Certificate for Payment shall be made first from the Improvement Account until such Improvement Account has been fully depleted, and second from the Developer Improvement Account of the Project Fund.

  • If the City Representative provides written instruction to the Trustee, the Trustee shall open a Developer Improvement Account under the Project Fund, and the funds held therein shall not be Pledged Funds or part of the Trust Estate.

  • Money on deposit in the Developer Improvement Account, if such an account is established pursuant to the written instruction of the City Representative, is a cash deposit securing the Developer’s performance of certain obligations under the Development Agreement relating to payment for completion of the offsite wastewater improvements.

  • The Developer Improvement Account shall be maintained and used for the purposes, and in accordance with the provisions, stated in the following Section 6.5 of this Indenture.

  • Any money on deposit in the Developer Improvement Account shall not be a part of the Trust Estate and is not security for the Bonds.

  • The disbursement of funds from the Developer Improvement Account pursuant to a City Certificate delivered under this Section 6.5 shall be deemed to be pursuant to and in accordance with the provisions of the Development Agreement and this Section 6.5 of the Indenture.

  • The Trustee shall be protected in disbursing funds from the Developer Improvement Account pursuant to a City Certificate delivered under this Section 6.5. If all of the money on deposit in the Developer Improvement Account is disbursed in accordance with a City Certificate delivered under this Section 6.5, the Developer Improvement Account shall be closed.

Related to Developer Improvement Account

  • Improvement Fund means the Improvement Fund for General Obligation Temporary Notes, Series 2017-1 created pursuant to Section 501 hereof.

  • Public improvement costs means the costs of:

  • Project Account means the account referred to in Section 3.04 (a) of this Agreement;

  • Needs Improvement the Educator’s performance on a standard or overall is below the requirements of a standard or overall, but is not considered to be unsatisfactory at this time. Improvement is necessary and expected.  Unsatisfactory: the Educator’s performance on a standard or overall has not significantly improved following a rating of needs improvement, or the Educator’s performance is consistently below the requirements of a standard or overall and is considered inadequate, or both.

  • Infrastructure improvement means permanent infrastructure that is essential for the public health and safety or that:

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Home improvement contractor or "contractor" means a person who sells goods and services, or agrees to furnish or render services, to a retail buyer pursuant to a home improvement installment contract, or sells goods and services to a retail buyer pursuant to a home improvement charge agreement, but not in connection with construction of new homes.

  • Maximum medical improvement means that no further material improvement would reasonably be expected from medical treatment or the passage of time;

  • Home improvement means the remodeling, altering,

  • Infrastructure Improvements means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. Infrastructure improvements also include 1 or more of the following whether publicly or privately owned or operated or located on public or private property:

  • Development Property means a Property currently under development for use as an office or industrial building that has not become a Stabilized Property, or on which the improvements (other than tenant improvements on unoccupied space) related to the development have not been completed, provided that such a Development Property on which all improvements (other than tenant improvements on unoccupied space) related to the development of such Property have been completed for at least twelve (12) months shall cease to constitute a Development Property notwithstanding the fact that such Property has not become a Stabilized Property.

  • Individual development account means a contract between an account holder and a fiduciary organization, for the deposit of funds into a financial institution by the account holder, and the deposit of matching funds into the financial institution by the fiduciary organization, to allow the account holder to accumulate assets for use toward achieving a specific purpose approved by the fiduciary organization.

  • Improvement Costs means any additional expenditure on a fixed asset that materially increases the capacity of the asset or materially improves its functioning or represents more than 10% of the initial depreciation base of the asset;

  • Private Improvements means the improvements to be constructed on the Property that are not Public Improvements.

  • The Works/Project means the works to be executed or done under this contract.

  • Minimum Improvements means the acquisition of land and construction of a 64-unit market rate residential apartment building and related improvements. The Minimum Improvements are more fully depicted in Exhibit B, which is attached hereto and incorporated herein.

  • Improvement Plan means the plan required by the Authority from the Supplier which shall detail how the Supplier will improve the provision of the Goods and/or Services pursuant to Clause 29.1.1 (Authority Remedies);

  • Licensee Improvements means Improvements created, conceived, or reduced to practice by or for Licensee.

  • Developed Property means all Assessor’s Parcels of Taxable Property for which Building Permits were issued on or before May 1 of the prior Fiscal Year, provided that such Assessor's Parcels were created on or before January 1 of the prior Fiscal Year and that each such Assessor's Parcel is associated with a Lot, as determined reasonably by the Board.

  • Project Improvements means site improvements and facilities that are:

  • Construction Account means the account by that name established in the FGR Subordinated Indebtedness Fund pursuant to the Second Resolution.

  • Joint Improvements means Improvements the inventors of which are jointly (a) employees of, or others obligated to assign inventions to, ImmunoGen or any Affiliate of ImmunoGen, and (b) employees of, or others obligated to assign inventions to, Lilly or any Affiliate of Lilly.
