Examples of Diligence Period in a sentence
The Due Diligence Period, and Xxxxxx’s associated termination right, expired on December 21, 2022.
If Buyer does not terminate this Agreement within the Due Diligence Period, then the Association Documents, the Title Commitment and all other matters relating to the Property shall be deemed approved by Buyer, and Buyer irrevocably waives any further right to terminate this Agreement or obtain a refund of the Deposit except where such right is expressly provided and grounds for such termination exist under other paragraphs of this Agreement.
If Buyer determines in Buyer’s sole discretion that any of Buyer’s investigations reveal any matters unacceptable to Buyer or that the Title Commitment or any of the Xxxxx Ranch Homeowners Association Documents are unsatisfactory, Buyer may, prior to the expiration of the Due Diligence Period, provide written notice to Seller terminating this agreement, in which event the Initial Xxxxxxx Money deposit shall be returned to Buyer.
Failure to provide written notice canceling the Contract prior to expiration of the Due Diligence Period shall be a waiver of the Due Diligence Contingency.
If no notice is received by the Seller within the Due Diligence Period Buyer’s right to terminate this Agreement shall be deemed waived.
