Examples of Effective competition in a sentence
The rates and charges for Cable Service provided pursuant to this Franchise shall be subject to regulation in accordance with federal law, and in no event shall Franchisee be subject to rate regulation, except to the extent Franchisee is no longer subject to Effective Competition (as that term is defined by federal law) or such rate regulation is authorized to be imposed as a result of a change in federal law.
Notwithstanding, the City may initiate enforcement of this Section despite the existence of Effective Competition based on the City's receipt of at least five (5) complaints with respect to each competitor, concerning similar customer service matters.
The Town acknowledges that, on the effective date of this Franchise Agreement, the Franchisee is subject to Effective Competition as defined by federal law.
In the event Grantor contends that Effective Competition, as defined in 47 U.S.C. § 543(l)(1) and 47 C.F.R. § 76.905(b) no longer exists in the Franchise Area, Grantor shall have the right to file a certification with the FCC seeking authority to exercise rate regulation to the extent authorized by law, or to refrain from exercising such regulation for any period of time.
The City intends to stay enforcement of this Section 5 to the extent Effective Competition exists.
