Eligible Stocks includes any common or preferred stock which (i) is not control or restricted stock under Rule 144 of the General Rules and Regulations promulgated by the Securities and Exchange Commission under the Securities Act of 1933, as amended, or subject to any other regulatory or contractual restrictions on sales, (ii) is traded on a U. S. national stock exchange, including NASDAQ, with a liquidity on such exchange for such stock acceptable to the Lender and (iii) has, as of the close of trading on the applicable exchange (excluding after hours trading), a per share price of at least Ten Dollars ($10).
Eligible Stocks means any common or preferred stock which (i) is not subject to statutory or contractual restrictions on sales, (ii) is traded on a U.S. national stock exchange or included in the National Market tier of NASDAQ and (iii) has, as of the close of trading on the applicable exchange (excluding after hours trading), a per share price of at least $15.

Examples of Eligible Stocks in a sentence

  • On each Business Day prior to 16:30 London time, the Warehouse must report to the Exchange the quantity of LME Eligible Stocks which it holds on that Business Day.

  • For purposes of this Guaranty: "Eligible Stocks" shall include any common or preferred stock which (i) is not subject to statutory or contractual restrictions on sales, (ii) is traded on a U.S. national stock exchange or included in the National Market tier of NASDAQ and (iii) has, as of the close of trading on the applicable exchange (excluding after hours trading), a per share price of at least $15.

More Definitions of Eligible Stocks

Eligible Stocks shall include any common or preferred stock which (i) is not subject to statutory or contractual restrictions on sales, (ii) is traded on a U.S. national stock exchange or included in the National Market tier of NASDAQ and (iii) has, as of the close of trading on the applicable exchange (excluding after hours trading), a per share price of at least Fifteen Dollars ($15).
Eligible Stocks means any common or preferred stock which (i) is not subject to statutory or contractual restrictions and is freely saleable on the public market, or (ii) is traded on the New York Stock Exchange, American Stock Exchange, or included in the National Market tier of NASDAQ. On a quarterly basis and as part of the delivery of quarterly financial statements as required in Section 5.1, Borrower or Guarantor, as applicable, shall provide Lender a certification on behalf of such party that such party is in compliance with the Liquid Assets Covenant set forth herein in form reasonably acceptable to Lender.

Eligible Stocks means any common or preferred stock which (a) is not subject to statutory or contractual restrictions on sales, transfers or dispositions, (b) is traded on a U.S. national stock exchange or included in the National Market tier of NASDAQ and (c) is issued by a company with a market capitalization, as of the close of the most recent trading day (excluding after hours trading), of at least $500,000,000, and has, as of the close of the most recent trading day (excluding after hours trading), a per share price of at least $15.00.
