Energy Savings Guarantee definition

Energy Savings Guarantee means the energy savings and performance guarantee provided by the ESCO under an ESPC Procurement, which guarantees to the Contracting Agency that certain energy savings and performance will be achieved for the project covered by the RFP, through the installation and implementation of the agreed-upon ECMs for the project. The Energy Savings Guarantee shall include, but shall not be limited to, the specific energy savings and performance levels and amounts that will be guaranteed, provisions related to the financial remedies available to the Contracting Agency in the event the guaranteed savings and performance are not achieved, the specific conditions under which the ESCO will guarantee energy savings and performance (including the specific responsibilities of the Contracting Agency after final completion of the design and construction phase), and the term of the energy savings and performance guarantee.
Energy Savings Guarantee means, pursuant to Division 3 of this Contract and Schedules 2 and 5 to Division 3, the units of energy and the corresponding sum that ESCO represents that the Facility will realize from energy and water savings resulting from the implementation of energy efficiency measures.
Energy Savings Guarantee has the meaning set forth in Paragraph 5.2, and shall consist of both the Total Guaranteed Savings and the Annual Guaranteed Savings.

Energy Savings Guarantee means the
Energy Savings Guarantee in respect of a Guarantee Year, means the guaranteed Energy Savings for that Guarantee Year as specified in paragraph 1 of Schedule 10 (Energy Savings Guarantee).

  • Guaranteed energy savings contract means a contract that includes all of the following:

  • Energy Savings means an amount of saved energy determined by measuring and/or estimating consumption before and after implementation of an energy efficiency improvement measure, whilst ensuring normalisation for external conditions that affect energy consumption;

  • Performance Guarantee means the security to be provided by the Contractor in accordance with Sub Clause 10.1 for the due performance of the Contract.

  • Consumer Guarantee means a Consumer Guarantee applicable to the Contract under the Australian Consumer Law;

  • Subsidiary Guarantee means any guarantee of the obligations of the Issuers under this Indenture and the Notes by any Subsidiary Guarantor in accordance with the provisions of this Indenture.
