Environmental Condition definition

Environmental Condition means any condition or circumstance, including the presence of Hazardous Substances which does or would (i) require assessment, investigation, abatement, correction, removal or remediation under any Environmental Law, (ii) give rise to any civil or criminal Liability under any Environmental Law, (iii) create or constitute a public or private nuisance or (iv) constitute a violation of or non-compliance with any Environmental Law.
Environmental Condition has the meaning ascribed to it in Part E of the Network Code; "Environmental Damage" has the meaning ascribed to it in Part E of the Network Code; "European licence" has the meaning ascribed to it in section 6(2) of the Act;
Environmental Condition means any contamination or damage to the environment caused by or relating to the use, handling, storage, treatment, recycling, generation, transportation, release, spilling, leaching, pumping, pouring, emptying, discharging, injection, escaping, disposal, dumping or threatened release of Hazardous Materials by any Person. With respect to claims by employees or other third parties, Environmental Condition also includes the exposure of Persons to amounts of Hazardous Materials.

Examples of Environmental Condition in a sentence

  • In the event Consultant or any other party encounters a Hazardous Environmental Condition, Consultant may at its option suspend performance of services until Owner: a) retains appropriate consultant(s) or contractor(s) to identify and remediate or remove the Hazardous Environmental Condition; and b) warrants that the Project site is in full compliance with all applicable environmental laws.

  • Borrower shall not do, nor allow anyone else to do, anything affecting the Property (a) that is in violation of any Environmental Law, (b) which creates an Environmental Condition, or (c) which, due to the presence, use, or release of a Hazardous Substance, creates a condition that adversely affects the value of the Property.

  • Contractor shall be responsible for a Hazardous Environmental Condition created with any materials brought to the Site by Contractor, Subcontractors, Suppliers, or anyone else for whom Contractor is responsible.

  • The Buyer acknowledges and agrees that it is relying entirely on its own due diligence, advice in relation to the reliability of any Property Reports, and its own independent investigations to satisfy itself fully on every aspect of the Property, including the Environmental Condition and Geotechnical Condition of the Property.

  • Unless expressly stated otherwise in the Scope of Services (Part I) of this Agreement, Consultant's scope of services does not include any services relating to a Hazardous Environmental Condition, including but not limited to the presence at the Project site of asbestos, PCBs, Petroleum, Hazardous Substances or any other pollutant or contaminant, as those terms are defined in pertinent federal, state and local laws.

Environmental Condition means any condition, known or unknown, foreseen or unforeseen, arising out of: (1) the handling, Releases, threat of Release or exposure of Persons to Hazardous Substances; (2) any violation of Environmental Laws; (3) the Handling of Hazardous Substances; and (4) any Environmental Claim.
Environmental Condition means the presence or Release of a Regulated Substance (other than a naturally-occurring substance) on or in environmental media, or structures on Real Property, at an Off-Site Location or other property (including the presence in surface water, groundwater, soils or subsurface strata, or air), including the subsequent migration of any such Regulated Substance, regardless of when such presence or Release occurred or is discovered.
Environmental Condition means a condition agreed under section 48F of the EP Act or decided under section 48J of the EP Act.
Environmental Condition means the disposal, release or threatened release, or presence in soil or groundwater, of any Hazardous Substance or any violation of any Environmental Law.
Environmental Condition means any condition with respect to soil, surface waters, groundwater, land, stream sediments, surface or subsurface strata, ambient air and any environmental medium comprising or surrounding the Real Property, which results in any damage, loss, cost, expense, claim, demand, order or liability to or against Seller or Buyer by any third party (including, without limitation, any government entity) as a result of a violation of any applicable Environmental Laws.
Environmental Condition means the Release of any Hazardous Materials in, over, on, under, through, from or about the Project (including, but not limited to, the Premises).
Environmental Condition means the presence or Release to the environment at the site of the Project Facilities of Hazardous Substances, including any migration of those Hazardous Substances through air, soil or groundwater to or from the site of the Project Facilities.
