ERISA Indemnity definition

ERISA Indemnity means, with respect to a Property or Properties located in the State of California, the ERISA Indemnity Agreement executed and delivered by Guarantor to Lender in a form satisfactory to Lender and modified to reflect the laws of the state where the Property is located and otherwise as Lender deems necessary or appropriate in its sole discretion, and as amended, supplemented, restated, or otherwise modified from time to time in accordance with the provisions hereof or thereof.
ERISA Indemnity means, with respect to an Individual Property located in the States of California, Idaho, Montana, Nevada, Utah or Washington, the ERISA Indemnity Agreement executed and delivered by the applicable Owner, the applicable Operator and Recourse Guarantor to Lender in a form satisfactory to Lender and modified to reflect the laws of the state where the Individual Property is located and otherwise as Lender deems necessary or appropriate in its sole discretion, and as amended, supplemented, restated, or otherwise modified from time to time in accordance with the provisions hereof or thereof.
