Facilities Owner definition

Facilities Owner means each Person who, as of the relevant time, is a "Participant" under the Facilities Co-Tenancy Agreement, which, as of the date of this Agreement, means APS, El Paso Electric Company, Public Service Company of New Mexico, Salt River Project Agricultural Improvement District, Seller and Tucson Electric Power Company, in each case in such Person's capacity as a Participant.
Facilities Owner means each Person who, as of the relevant time, is a “Participant” under the Facilities Co-Tenancy Agreement, which, as of the date of this Agreement, means Purchaser, Public Service Company of New Mexico, Salt River Project Agricultural Improvement and Power District, Seller and Tucson Electric Power Company, in each case in such Person’s capacity as a “Participant”.
Facilities Owner means All Individual and General Licence Holders, Any owner and/or lawful possessor of Tower and Mast facilities (licensed or unlicensed, natural or juristic person)

  • If the Expert determines that such capital improvement does not, or when constructed will not, comply with the Operating Standard or will unreasonably interfere with the Operation of the Managed Facilities, Owner shall promptly take such actions as the Expert shall require to bring such capital improvement into compliance with the Operating Standard or to cause such capital improvement to not unreasonably interfere with the Operation of the Managed Facilities.

  • Owner’s Engineer and any equity participant in Owner or Common Facilities Owner, shall also have the right to witness off-site tests and receive copies of all off-site test results to the same extent as Owner.

  • Such Persons, as well as Owner’s Engineer and any equity participant in Owner or Common Facilities Owner may also observe the performance of any other on-Site test and inspection.

  • Owner, Lenders’ Agent and the Independent Engineer, as well as Owner’s Engineer and any equity participant in Owner or Common Facilities Owner, may observe the performance of any such test and activity or inspection, and review the results of such tests and inspections.

  • Owner’s Engineer and any equity participant in Owner or Common Facilities Owner shall also have the opportunity to witness any such inspection.

  • Without limiting the generality of the foregoing, Purchaser has reviewed, understands, and at the Closing will be able to perform all of its obligations as a Facilities Owner under the Facilities Contracts, including the Four Corners Financial Assurance Policy.

  • In the event such changes require alteration to the Facilities, Owner shall be responsible for the costs of such alterations.
