Final FERC Order definition

Final FERC Order means a final order issued by FERC pursuant to an application filed by PG&E to amend the license for FERC Project No. 1121 to implement the applicable measures of this Restoration Project, after exhaustion of any administrative or judicial remedy.
Final FERC Order means an order of FERC: (a) as to which no filing, intervention, appeal or notice of appeal (i) to amend or make additional findings of fact, (ii) to alter or amend the requested relief to which such order relates, or (iii) to request rehearing, reconsideration or application for review of the requested relief to which such order relates, or other similar filing, intervention, appeal or notice of appeal shall have been filed within the time for appeal or notice of appeal (collectively, a “ Specified Challenge”), or, if there has been a Specified Challenge, it has been disposed of in a manner that upholds and affirms the requested relief to which such order relates in all respects without the possibility for any further appeal therefrom; and (b) as to which the time for instituting or filing an appeal shall have expired.
Final FERC Order means a FERC order that is no longer subject to further rehearing before FERC regardless of whether such order is subject to appeal, provided that such order has not been stayed pending such appeal. The “date” of a Final FERC Order shall be the date upon which it is no longer subject to rehearing.

More Definitions of Final FERC Order

Final FERC Order means a dispositive order by FERC on the merits, and does not include any interim order. A dispositive order on the merits is, for purposes of this section, final when issued and there is no need to await a FERC order on rehearing before the decision is considered final.
Final FERC Order means a final order issued by FERC which is no longer subject to rehearing or judicial review and is not the subject of proceedings at FERC on remand from any court. Final Monthly Energy Allocation or “FMEA” means a quantity of Energy expressed in MWh which, for any Billing Month, is the PMEA adjusted for any billing or metering errors found subsequent to the calculation of PMEA of which MISO is notified prior to the last date on which MISO issues a settlement statement for a previous operating day for the Billing Month. Financial Transmission Rights or “FTRs” has the same meaning ascribed to the term in the applicable MISO Rules. Firm Transmission Service means “Network Integration Transmission Service” under the MISO Rules. In the event the MISO Rules are modified such that “Network Integration Transmission Service” is no longer offered, Firm Transmission Service means the type of transmission service offered under the MISO Rules that is accorded the highest level of priority for scheduling and curtailment purposes. FirstEnergy Balancing Authority means the geographic region represented by the combined service territories of The Cleveland Electric Illuminating Company, The Toledo Edison Company, Pennsylvania Power Company and Ohio Edison Company, as may be modified from time to time, and which is recognized by the North American Electric Reliability Council as the "FirstEnergy Balancing Authority."

  • Bid Procedures Order means an Order of the Bankruptcy Court that (a) is in substantially the form set forth as Exhibit A to this Agreement or otherwise in a form reasonably satisfactory to the Sellers and acceptable to the Buyer in its sole discretion, and (b) approves procedures for the solicitation and consideration of competitive bids for the Assets under the terms and conditions of this Agreement and authorizing the protections set forth in Article 11 for the Buyer.
