Future Government Support Program definition

Future Government Support Program means any program, facility or offering administered or made available by a Governmental Authority that provides cash subsidies, grants or payments on account of capital costs for the development and construction of the Facility or based on the output or performance of the Facility, pursuant to documented guidelines, program rules, prescribed forms of contracts or standardized commercial terms that are published or first publicly announced by the applicable Governmental Authority after the Proposal Submission Deadline. For greater certainty, any funding or financing program or offering by the Canada Infrastructure Bank that is specially designed and intended for use by participants in the E-LT1 RFP and that is publicly announced prior to the Proposal Submission Deadline will not constitute a Future Government Support Program.

For certainty, Future Government Support Program excludes the measures referred to as the “Clean Technology Investment Tax Credit” or the “Clean Electricity Investment Tax Credit” in the Government of Canada’s Budget 2023: A Made-in-Canada Plan released and tabled in the Parliament of Canada on March 28, 2023.

  • Notwithstanding the foregoing, the treatment of any such Additional Source of Funding under this Agreement shall in no event contravene the requirements of the relevant governmental program and in the case of any such possible contravention, the Supplier shall not participate in the applicable Future Government Support Program without the Buyer’s prior written consent, which may be granted in the Buyer’s sole and absolute discretion.

  • Credit Support Provider has the meaning specified in the Schedule.
