Generally Accepted in the Industry means utilized by no fewer than three of the top five of the Other SVOD Distributors, as determined by market share, that deliver to Approved Devices via the Internet utilizing an Approved Format, or in a manner similarly or more secure than the foregoing. Licensor acknowledges that as of the Effective Date, the content protection system utilized by Licensee is Generally Accepted in the Industry. Notwithstanding the foregoing, the copy protection and security requirements in this Section 11.1 shall not apply to distribution of Included Programs to Approved Set-top Boxes, which shall be governed by the provisions set forth in the Set-top Agreement.
Generally Accepted in the Industry means utilized by no fewer than three of the top five of the other DHE distributors in the Territory, as determined by market share, that deliver to Approved IP Devices via the Internet utilizing Windows DRM, Silverlight, Adobe or Move Networks DRM, or Widevine; provided, that in the event Comcast utilizes technologies, methods or other protections as of the date hereof or hereafter (including pursuant to other agreements by and between Studio and Comcast) that are greater than what is Generally Accepted in the Industry, Comcast agrees that it shall not reduce or eliminate any such protections to conform to what is Generally Accepted in the Industry.

Generally Accepted in the Industry means utilized by no fewer than three of the top five of the Other SVOD Distributors, as determined by market share, that deliver to Authorized IP Devices via the Internet utilizing Windows DRM, Silverlight, Adobe or Move Networks DRM; provided, that in the event Licensee utilizes technologies, methods or other protections as of the date hereof (including those required under Section 10.5 hereof) or hereafter (including pursuant to that certain On-Line Video-On-Demand License Agreement dated as of July 11, 2008 by and between Licensor and Licensee) that are greater than what is Generally Accepted in the Industry, Licensee agrees that it shall not reduce or eliminate any such protections to conform to what is Generally Accepted in the Industry. Notwithstanding the foregoing, the copy protection and security requirements in this Section 10.1 shall not apply to distribution of Included Programs to Approved Settop Boxes, and rather the provisions set forth in the Settop Agreement shall apply to such distribution.
