GI Product definition

GI Product means an OBD Chronic Product, a Constipation Product, an ---------- IBS Product, or any Additional Product designated by the Parties as a GI Product pursuant to Section 4.3.
GI Product means any product indicated or developed for the treatment of gastrointestinal disease owned, developed, or licensed by aaiPharma, or any parent, subsidiary, or affiliate, other than (i) those containing omeprazole or S-omeprazole, or any derivatives thereof as an active ingredient or (ii) any 50 mg formulation of azathioprine sold by aaiPharma.

Examples of GI Product in a sentence

  • GSK shall be solely responsible for the filing and maintenance of (a) the GI Product Trademarks in the United States, and (b) the ROW Trademarks in the ROW, and all costs and expenses related thereto.

  • Adolor, at its option, may advise the customer who made the return that the GI Product should have been returned to GSK, but shall take no other steps in respect of any return without the consent of GSK, such consent not to be unreasonably withheld, refused, conditioned or delayed.

  • All licenses granted by Adolor to GSK with -------------- respect to the Adolor Products under this Agreement for the United States shall be terminated, except for any trademark or trade dress licenses if GSK is utilizing such Adolor Product Trademark with a GI Product being Commercialized in the United States or with a Collaboration Product being utilized in the ROW.

  • During the Term, in the event that GSK does not undertake such an infringement action with respect to a GI Product Trademark, upon GSK's written consent, which shall not be unreasonably withheld, refused, conditioned or delayed, Adolor shall be permitted to do so.

  • Party for a GI Product in the United States, where Adolor has elected to fund Development Expenses under Section 4.6.5 and has not made a Royalty Conversion Election, shall be made by Specialist Sales Representatives.

  • If a Party is a Defaulting Party for a Collaboration Product for ** (**) **, then the Adolor Product Marketing Contribution or the GI Product Marketing Contribution, as applicable, shall be permanently reduced and correspondingly increased for the other Party, by an amount equal to the average of the adjustments made for the ** (**) **.

  • Licensed Product means any pharmaceutical product containing a Licensed Compound (alone or with other active ingredients), in all forms, presentations, formulations and dosage forms.

  • Generic Product means any pharmaceutical product that (i) is sold by a Third Party that is not an Affiliate or licensee of Buyer and (ii) (a) contains the same active pharmaceutical ingredient as the Product or (b) is categorized by the applicable Governmental Entity in a country to be therapeutically equivalent to, or interchangeable with, the Product, such that the pharmaceutical product may be substituted for the Product at the point of dispensing without any intervention by the prescribing physician in such country.

  • Bundled Product means a Licensed Product sold or bundled together with other products.

  • Aerosol Product means a pressurized spray system that dispenses product ingredients by means of a propellant contained in a product or a product's container, or by means of a mechanically induced force. “Aerosol Product” does not include “Pump Spray.”

  • Licensed Compounds means: (a) Research Program Active Compounds; (b) Novartis Active Compounds; (c) salts, hydrates, solvates, esters, metabolites, intermediates, stereoisomers and polymorphs of Research Program Active Compounds or Novartis Active Compounds; and (d) prodrugs of Research Program Active Compounds or Novartis Active Compounds (any of the foregoing, a “Licensed Compound”).

  • Licensed Products means tangible materials which, in the course of manufacture, use, sale, or importation, would be within the scope of one or more claims of the Licensed Patent Rights that have not been held unpatentable, invalid or unenforceable by an unappealed or unappealable judgment of a court of competent jurisdiction.

  • Nicotine product means the same as that term is defined in Section 76-10-101.

  • Diagnostic Product means an assemblage of reagents, including but not limited to reagents packaged in the form of a kit, useful in performing a Licensed Service.
