Illinois Settlement Class definition

Illinois Settlement Class means all individuals with a primary Illinois residential address whose individual detail pages were displayed on Xxxxxxxxxx.xxx in response to a search on the website and whose names were clicked on between May 7, 2019 and January 27, 2022 where the searcher during that same site visit purchased a subscription. Excluded from the Illinois Settlement Class is (1) any Judge or Magistrate presiding over this action and members of their families, (2) Defendant, Defendant’s subsidiaries, parent companies, successors, predecessors, and any entity in which Defendant or its parents have a controlling interest, (3) persons who properly execute and file a timely request for exclusion from the class, and (4) the legal representatives, successors, or assigns of any such excluded persons.
Illinois Settlement Class means all policyholders, (except for those explicitly excluded below), under any property insurance policy issued by Metropolitan,2 who made: (i) a Structural Loss claim for property located in the State of Illinois between June 12, 2019 and November 16, 2020; and (ii) that resulted in an ACV Payment from which Nonmaterial Depreciation was withheld, or that would have resulted in an ACV Payment, but for the withholding of Nonmaterial Depreciation causing the loss to drop below the applicable deductible.
Illinois Settlement Class means all Illinois residents whose identity was the subject of a directory preview page published by ZoomInfo and viewed for the first time between April 15, 2020 and the date this Settlement is fully executed. Excluded from the Illinois Settlement Class are (1) individuals with directory pages whose only page views were the result of “bot” attacks identified in ZoomInfo’s records; (2) any Judge or Magistrate presiding over this action and members of their families, (3) ZoomInfo, ZoomInfo’s subsidiaries, successors, predecessors, and any entity in which ZoomInfo has a controlling interest, (4) persons who properly execute and file a timely request for exclusion from the class, and (5) the legal representatives, successors, or assigns of any such excluded persons.

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.
