No Participating Settlement Class Member shall be heard, and no papers, briefs, pleadings, or other documents submitted by any Participating Settlement Class Member shall be received and considered by the Court unless the objection is postmarked and mailed to the Settlement Administrator by no later than 45 Days after the Notice Deadline (the “Objection Deadline”).
Any Participating Settlement Class Member who fails to comply with the provisions in this section may waive and forfeit any rights he or she may have to object, and shall be bound by all the terms of the Settlement Agreement, this Order, and by all proceedings, orders, and judgments in this matter, including, but not limited to, the releases included in the Settlement Agreement if the Final Approval Order and Judgment is entered.
Any Settlement Class Member who wishes to be excluded from the Settlement Class must mail a written notification of the intent to exclude himself or herself from the Settlement Class (a “Request for Exclusion”) to the Settlement Administrator at the address provided in the Notice, postmarked no later than 45 Days after the Notice Deadline (the “Opt-Out Deadline”).
Once a Settlement Administrator is mutually agreed to by the Parties and after the Settlement is preliminarily approved by the Court, the Settlement Administrator will provide Notice to each Settlement Class Member by the means set forth in Paragraphs 56-57 hereof and in the form agreed to in Exhibit A (Short Form Notice) and Exhibit B (Long Form Notice).
The Notice must state that any Settlement Class Member who does not file a timely Request for Exclusion in accordance with this Paragraph will lose the opportunity to exclude himself or herself from the Settlement and will be bound by the Settlement.
