The Committee may amend the terms of any Award theretofore granted, prospectively or retroactively, with the approval of the Informal Committee Designee, but, subject to Section 5 of the Plan, no such amendment shall impair the rights of any Participant without his or her consent.
In the event agreement cannot be reached between the Debtors and the Informal Committee prior to the Effective Date, the Bankruptcy Court shall determine the amount of Plan Distribution Cash.
