Initial Plant definition

Initial Plant has the meaning set forth in Section 3.1.
Initial Plant means the first Polysilicon plant to be erected by JVCo in Jubail Industrial City with an expected production capacity of a total of *** metric tons (MT) per year.
Initial Plant means the Plant to be constructed by the Company in accordance with this Agreement.

Examples of Initial Plant in a sentence

  • The day-to-day operations of the Initial Plant shall be responsibility of the Plant Manager, who, subject to Section 8.1.2, shall be nominated by BioAmber Lux.

  • In addition, jointly with the owner of the Initial Plant Site, BioAmber has conducted a Phase II environmental assessment of the Initial Plant Site, a copy of which assessment has been made available to Mitsui.

  • The Company has entered into the financing agreements to finance the construction of the Initial Plant, with the respective Governmental Authorities and for the aggregate amounts, set forth in Schedule 17.1.8 (collectively, the “Government Finance Agreements”).

  • Seller agrees that if, based on the Initial Plant Capacity Test, the result of the Initial Plant Capacity Test (as adjusted by the AEP Adjustment Factor) shall have failed to equal or exceed the Minimum Guaranteed Plant Capacity, Seller shall pay an amount equal to the Initial Plant Capacity Liquidated Damages to Purchaser upon Project Substantial Completion.

  • It is the intent of the Shareholders to change the name of the Company to “BioAmber Sarnia Inc.” prior to commencing operations at the Initial Plant.


More Definitions of Initial Plant

Initial Plant means a 200 MMcf per day cryogenic natural gas processing plant owned by the JV and located within the AMI.

  • Phase III means human clinical trials, the principal purpose of which is to establish substantial evidence of both safety and efficacy in patients with the disease or condition being studied, as more fully defined in 21 C.F.R. §312.21(c) or similar clinical study in a country other than the United States. Phase III shall also include any other human clinical trial intended to serve as a pivotal trial to support the submission of an application for regulatory approval.

  • Commissioning Date means that date when construction of the contemplated Project is complete, and the Maintenance Term commences;
