The ▇▇▇▇▇▇▇ South Irrigation Well (the “Well”) is located on real property owned by ▇▇▇▇▇ at ▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇ (“Property”) in Carmel Valley, California (APN 416-028-027).
The Irrigation Well may: (i) only be used on the land depicted on Exhibit A and not on any other location; (ii) only be used for irrigation uses; and (iii) not be used for any commercial or industrial operations or purposes.
The Irrigation Well water shall be made available to the City through shared irrigation lines pursuant to the CLEF Operation and Maintenance Agreement.
The Irrigation Well may be used only during the historical irrigation season, which is no earlier than May 1 and no later than October 31 each year, and only when the Irrigation Well is operational.
The City agrees not to sell, lease, give, sublease, assign, or otherwise provide any portion of the Irrigation Well Water to any other person or entity without the express written consent of the County.
