Junior Lien Cap definition

Junior Lien Cap means, as of any date of determination, the aggregate amount of Junior Secured Debt that may be incurred by the Borrower and any Guarantor such that, after giving pro forma effect to such incurrence and the application of the net proceeds therefrom the Total Collateral Coverage Ratio shall be no less than 1.0 to 1.0.
Junior Lien Cap means, as of any date of determination, the amount of Junior Lien Debt that may be incurred by the Company such that, after giving pro forma effect to such Incurrence and the application of the net proceeds therefrom, the Total Leverage Ratio would not exceed 2.50 to 1.00.
Junior Lien Cap means the amount of “Priority Lien Debt” that may be Incurred by Peabody under the “Priority Lien Cap” in the Peabody 2024 Notes Indenture (each as defined in the Peabody 2024 Notes Indenture).

Junior Lien Cap means $300.0 million (plus the aggregate amount of accrued interest and the amount of all fees and expenses, including premiums, paid or incurred in connection with any refunding, replacement or other refinancing of Junior Lien Debt with the proceeds of other Junior Lien Debt that was permitted to be incurred under this Indenture), minus the aggregate amount of all Net Proceeds of any Sale of Collateral applied by United since the date of this Indenture to repay or redeem the Notes or any Junior Lien Debt under a Credit Facility that is term Indebtedness or to repay other Junior Lien Debt or to repay Junior Lien Debt under a Credit Facility that is revolving credit Indebtedness and effect a corresponding commitment reduction thereunder pursuant to Section 4.10 hereof, and minus the principal amount of any Permitted Refinancing Indebtedness not constituting Junior Lien Debt the proceeds of which are applied to refinance, refund, repay, redeem, defease or otherwise acquire or retire for value any Junior Lien Debt.
Junior Lien Cap means the amount of Indebtedness that may be incurred by Peabody under the Peabody L/C Agreement and each other Priority Lien Document that is pari passu with the Liens and Obligations and subject to the Collateral Trust Agreement (each as defined in the Peabody L/C Agreement) or such lesser amount of such Indebtedness that is permitted to be outstanding as of the date of any determination under any Priority Lien Document (as defined in the Peabody L/C Agreement).
Junior Lien Cap means the maximum amount of Junior Lien Debt that may be incurred by the Company such that, after giving pro forma effect to such incurrence and the application of the net proceeds therefrom, the Consolidated Secured Leverage Ratio for the period for the most recently ended four full consecutive fiscal quarters for which internal financial statements are available immediately preceding the date of such incurrence would not exceed 4.5 to 1.0.
