KNOWING AND VOLUNTARY EXECUTION. The Participant has carefully read this agreement and fully understands its contents. The Participant is aware that this is a contract between themselves and ECOLOGY ACTION and contains an assumption of risk and release of liability, and the Participant signs it of their own free will. By signing this agreement, the Participant certifies that they are eighteen years of age or older.

  • Knowing and "knowingly" means that a person is in possession of facts under which he or she is aware or should be aware of the nature of his or her conduct and that his or her conduct is substantially certain to cause the payment of a medicaid benefit.   • Constructive Dismissal means, unless consented to by the Participant, any action that constitutes constructive dismissal of the Participant, including without limiting the generality of the foregoing:
