Examples of Land Assembly Agreement in a sentence
In relation to any other Development Business Plans for future Development Sites (or parts thereof) identified in accordance with Schedule 3 (Future Opportunities) of the Land Assembly Agreement or Clause 16.1 (Opportunities), the DevLLP Board shall procure the preparation of a draft Development Business Plan for approval by the Members.
The HDV’s obligation to adhere to the Housing Strategy is set out in the Land Assembly Agreement considered by Cabinet as part of the 3 July decision, which includes (at section 3.1.2) a requirement that ‘The HDV shall ensure in drawing up any Development Business Plan or Planning Application for a Category 1A Property (or Phase thereof), it is consistent with…the Council’s housing policies, as notified to the HDV from time to time, including the Council’s Housing Strategy…’.
It is assumed that this concern relates to the ‘Qualifications’ in relation to the Estate Renewal Rehousing and Payments Policy, as set out in the Land Assembly Agreement considered by Cabinet at its 3 July meeting (rather than to the Members’ Agreement).
This includes an agreed approach to consultation and engagement, and a commitment by the HDV to honour the terms of the Council‟s draft Estate Renewal Rehousing and Payments policy, which was approved by Cabinet on 20 June 2017 for public consultation, except where any departure from the ERRPP has been expressly agreed (including by the Council) either in the relevant scheme business plan or the Land Assembly Agreement itself and subject to certain specific clarifying qualifications.
The Land Assembly Agreement by and between the City and the Developer, attached hereto as Exhibit A, providing for certain agreements between the City and the Developer for the acquisition of certain Phase One Property and defining the duties and responsibilities of the parties with regard thereto all in accord with the development of the Commercial Project is hereby approved and the City Manager for and on behalf of this City, is hereby authorized to execute that Land Assembly Agreement.
The Land Assembly Agreement also sets out the obligations of the HDV to existing Council tenants and leaseholders who are resident on a site proposed for development, including a right to return to a new home on the estate and on equivalent terms.
The Cabinet Member emphasised that the commitment to a right of return was already absolute, both in the HDV Land Assembly Agreement and in the Estate Renewal Rehousing and Payments Policy.
In response to a request for further information around the alleged contradiction of Council polices and the proposals contained in the HDV, Mr Burnham advised that the Council was in the process of revising its estate renewal and rehousing policy to include a right of return for housing association tenants, which the HDV Land Assembly Agreement stated would not be offered for housing association tenants.
This is made explicit – and binding – in section 10 of the Land Assembly Agreement, and is not affected by the Qualifications. Where the business plans prioritise ‘single move’, this describes the modelling that has been done so far to map the options for the rehousing work necessary to unlock the projects.
The Cabinet Member accepted that some of the wording in the Land Assembly Agreement could have been clearer, and he agreed to amend this in the final documents to make it more clear and transparent.
