Regulatory Exclusivity means any exclusive marketing rights or data exclusivity rights conferred by any Regulatory Authority with respect to a pharmaceutical product other than Patents, including orphan drug exclusivity, new chemical entity exclusivity, data exclusivity, or pediatric exclusivity.
Regulatory Exclusivity Period means, with respect to each Licensed Product in any country in the Territory, a period of exclusivity (other than Patent exclusivity) granted or afforded by Applicable Law or by a Regulatory Authority in such country that confers exclusive marketing rights with respect to such Licensed Product in such country or prevents another Person from using or otherwise relying on any data supporting the approval of the Drug Approval Application for such Licensed Product to support an application for regulatory approval of another product for any indication without the prior written consent of the Drug Approval Application holder.
Exclusivity means the specificity of the test method for validating microbial testing methods. It evaluates the ability of the method to distinguish the target organisms from similar but genetically distinct non-target organisms.
Classroom exclusion means the exclusion of a student from a classroom or instructional or activity area for behavioral violations, subject to the requirements of WAC 392-400-330 and 392-400-335. Classroom exclusion does not include action that results in missed instruction for a brief duration when:
Permanent exclusion means the student is banned forever from attending a public school in the State of Ohio. (See Policy 5610.01)
License Term means the duration of a License as specified in the Order.
Sexual excitement means the condition of human male or female genitals when in a state of sexual stimulation or arousal.
Exclusive License has the meaning set forth in Section 3.1.
Proprietary product means a manufactured component or other product that is produced by a private person. It may be protected by patent, trademark or copyright.
Dark pattern means a user interface designed or manipulated with the substantial effect of subverting or impairing user autonomy, decision- making, or choice and includes any practice the Federal Trade Commission refers to as a “dark pattern.”
Exclusivity Period shall have the meaning set forth in Section 6.11.
License Key means a unique key-code that enables Licensee to run Software subject to the obtained User Pack.
License Type means the identification of whether the license for a Software Product is for a Perpetual Term or Subscription Term as specified in the Quote.
Notice of Exclusive Control has the meaning given to such term in the Control Agreement.
Patent Term Extension means any term extensions, supplementary protection certificates and equivalents thereof offering Patent protection beyond the initial term with respect to any issued Patents.
Exclusive Field means the diagnosis, treatment or prevention of any cancer in humans through the use of Engineered T-Cells, which shall exclude the diagnosis, treatment or prevention of medullary cystic kidney disease 1 regardless of whether such disease is characterized as a cancer.
Sexual Exploitation and Abuse “(SEA)” means the following:
Top Level Domain means the portion of the Domain Name to the right of the right-most period. (In the example, “COM”.) “Second Level Domain” means that portion of a domain name to the left of the right-most period, up to the second period from the right, if any, plus the Top Level Domain. (In the example, “XXXXXXXXX.XXX”.) “Third Level Domain” means that portion of a domain name to the left of the second period from the right, if any, up to the third period from the right, if any, plus the Second Level Domain. (In the example, “XXXXXXXXX.XXXXXXXXX.XXX”.).
Exclusive Period means the period of time set forth in Section 2.2.
Commercial Launch means the initial First Commercial Sale of a Product in the Territory.
Sexual exploitation means any actual or attempted abuse of a position of vulnerability, differential power, or trust for sexual purposes. It includes profiting monetarily, socially, or politically from sexual exploitation of another.
License expiration date means June 30 of even-numbered years.
Non-Microsoft Product means any third-party-branded software, data, service, website or product, unless incorporated by Microsoft in a Product.
License plate means a device containing letters, numerals, or a combination of both, attached to a
Competitive negotiation means a procedure for contracting for supplies, materials, equipment or contractual services, in which proposals are solicited from qualified suppliers by a request for proposals, and changes may be negotiated in proposals and prices after being submitted.
Launch Date has the meaning specified therefor in Section 2.02(b) of this Agreement.
