In matters not regulated in these Terms of Reference (SIWZ), the applicable regulations shall be those of the Public Procurement Act of 29 January2004 and the Civil Code of 23 April 1964, unless otherwise provided in the Public Procurement Act.
If on any Business Day the Seller Interest is greater than the Minimum Seller Interest, amounts on deposit in the Excess Funding Account shall be released to the Holder of the Exchangeable Seller Certificate.
