Nothing contained herein shall be construed to deny Shipper any rights it may have under the Natural Gas Act, including the right to participate fully in rate or other proceedings by intervention or otherwise to contest increased rates in whole or in part.

The common carrier provisions of this section shall not apply to any natural gas pipe- line operated by any person subject to regula- tion under the Natural Gas Act [15 U.S.C. 717 et seq.] or by any public utility subject to regula- tion by a State or municipal regulatory agency having jurisdiction to regulate the rates and charges for the sale of natural gas to consumers within the State or municipality.
