No Condemnation or Expropriation. Neither the whole nor any portion of the property or any other assets of Company is subject to any Order to be sold or is being condemned, expropriated or otherwise taken by any Government Entity with or without payment of compensation therefor, nor to the best of Company's and Shareholders' knowledge has any such condemnation, expropriation or taking been proposed.
No Condemnation or Expropriation. Neither the whole nor any portion of the property or any other assets of Seller to be conveyed to Buyer is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any public authority with or without payment of compensation therefore, nor to the best of Seller's, its officers' and directors' knowledge has any such condemnation, expropriation or taking been proposed.
No Condemnation or Expropriation. Neither the whole nor any portion of the property or leaseholds owned or held by Berten or any of its Subsidiaries is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any Governmental Body or other Person with or without payment of compensation therefor, which action is likely to have a material adverse effect on the business or financial condition of Future Projects and its Subsidiaries, taken as a whole.
No Condemnation or Expropriation. Neither properties demised under the Leases, or any portion thereof or any other assets of the Company is subject to any governmental decree or order to be sold of which the Company has received notice or is being condemned, expropriated or otherwise taken by any public authority with or without payment of compensation therefor, nor, to the knowledge of the Company, has any such condemnation, expropriation or taking been proposed.
No Condemnation or Expropriation. Neither the whole nor any portion of the property or leaseholds owned or held by PCLICK or any of its subsidiaries is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any Governmental Body or other Person with r without payment of compensation therefore, which action is likely to have a material adverse effect on the business or financial condition of ECNC and its Subsidiaries, taken as a whole.
No Condemnation or Expropriation. Neither the whole nor any portion of the Assets is subject to any government decree or order to be sold or is being condemned, expropriated or otherwise taken by any domestic or foreign public authority with or without payment of compensation thereof, nor, to Seller's knowledge, has any such condemnation, expropriation or taking been proposed in writing within the past two years.
No Condemnation or Expropriation. Except as disclosed on -------------------------------- Schedule 3.12, neither the whole nor any portion of the Real Estate or any leasehold of the Company is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any public authority with or without payment of compensation therefor, nor, to the knowledge of Seller, has any such condemnation, expropriation or taking been proposed.

Neither the whole nor any portion of the property or any other assets of IRG or CNR is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any public authority with or without payment of compensation therefor, nor to CC Holdings' and IRG's knowledge has any such condemnation, expropriation or taking been proposed.
No Condemnation or Expropriation. Neither the whole nor any -------------------------------- portion of MGE's Interest in the Nuclear Plant (nor, to MGE's knowledge, any of the assets (real, personal or intangible) of the Nuclear Plant) is subject to any Order to be sold or is being condemned, expropriated or otherwise taken by any Government Entity with or without payment of compensation therefor, nor, to MGE's knowledge, has any such condemnation, expropriation or taking been proposed.
No Condemnation or Expropriation. Neither the Company nor any of its subsidiaries has received written notice to the effect that the whole or any material portion of the real properties owned or leased by the Company or any of its subsidiaries is subject to any governmental decree or order to be sold or is being condemned, expropriated or otherwise taken by any public authority with or without payment of compensation therefor, or that any such condemnation, expropriation or taking has been proposed, which would have a material adverse effect on the Company and its subsidiaries, taken as a whole.
