Non-Compliant Product definition

Non-Compliant Product means unregistered, counterfeit, substandard and any other product that shall be determined by the Authority.
Non-Compliant Product. If, after examining the product, Varitron RPM concludes that it does not comply with the terms of the warranty, Varitron RPM will return the product to the Customer at the latter's expense, as stipulated in the paragraph above, entitled "Delivery/Shipping," provided the Customer has prepaid the shipping costs and the inherent Taxes, and pays Varitron RPM the inherent costs associated with the handling and verification of product compliance. If the Customer does not pay these costs and Taxes within thirty (30) days of the date of the invoice, Varitron RPM will not recognize any obligation to return the products to the Customer, and shall deem the products to be its own property. If the product is delivered to Varitron RPM and parts or components are missing or damaged, additional fees will be charged to the Customer to replace them.

Examples of Non-Compliant Product in a sentence

  • Licensee and its Affiliated Companies shall terminate the distribution and sales of the Non-Compliant Product within thirty (30) days after receipt of the final Non-Compliance Notice.

  • Licensee and/or its Affiliated Companies shall undertake a commercially reasonable effort to inform everyone who may have a Non-Compliant Product in its possession that such Product is Non-Compliant and may not work correctly in combination with other Products carrying the Zhaga Logo.

  • Licensee and/or its Affiliated Companies may continue the distribution and/or sales of the Non-Compliant Product for an additional sixty (60) days, provided that a prominent warning is attached to each Non-Compliant Product or on the packaging of each Non-Compliant Product, stating explicitly that such Non-Compliant Product is not Fully Compliant and may not work correctly in combination with other Products carrying the Zhaga Logo.

  • If the sample analysis is found to be --------- non-compliant, the entire 50,000 Gallons of Product from which the sample was taken will be deemed non-compliant (the "Non-Compliant Product"), and the Inspector shall immediately notify both Parties.

  • Licensee and its Affiliated Companies shall terminate the distribution and sales of the Non-Compliant Product within thirty (30) days after receipt of the Final Non-Compliance Notice.

  • Seller shall use its best efforts to dispose of any Non-Compliant Product promptly upon notification of its non-compliance by the Inspector and shall be responsible for any and all costs and liabilities relating to or arising from the Non-Compliant Product.

  • If the sample analysis is found to be non-compliant, the entire 50,000 Gallons of Product, from which the sample was taken, will be deemed non-compliant (the "Non-Compliant Product"), and the Inspector shall immediately notify both Parties.
