Nonconforming Waste Material definition

Nonconforming Waste Material means Waste Material: (i) that contains materials not described in the applicable Uniform Hazardous Waste Manifest: (A) that materially increases the cost to Disposer of providing Services; (B) that materially increases the nature or extent of the hazard and risk of providing Services with respect to such Waste Material; or (C) that causes such Waste Material to be unauthorized for the applicable Services at the designated TSD under Applicable Law or due to the design, policies or permit conditions of the designated TSD or (ii) that is improperly containerized, labeled, marked or placarded by Aerojet Rocketdyne. The term Nonconforming Waste Material excludes any Waste Material for which Disposer has not rightfully revoked its acceptance pursuant to Section 5 hereof.
Nonconforming Waste Material means Waste Material: i. that contains materials not described in the applicable Uniform Hazardous Waste Manifest: (A) that materially increases the cost to Transporter of providing Services; (B) that materially increases the nature or extent of the hazard and risk of providing Services with respect to such Waste Material; or (C) that causes such Waste Material to be unauthorized for the applicable Services or ii. that is improperly containerized, labeled, marked or placarded by Aerojet Rocketdyne. The term Nonconforming Waste Material excludes any Waste Material for which Transporter has not rightfully revoked its acceptance pursuant to Section 4 hereof.
Nonconforming Waste Material means Waste Material: (a) that contains materials not described in the applicable Uniform Hazardous Waste Manifest: (i) that materially increases the cost to DISPOSER of providing Services; (ii) that materially increases the nature or extent of the hazard and risk of providing Services with respect to such Waste Material; or (iii) that causes such Waste Material to be unauthorized for the applicable Services at the designated Facilities under applicable law or due to the design, policies or permit conditions of the designated Facilities or (b) that is improperly containerized, labeled, marked or placarded by GENCORP. The term Nonconforming Waste Material excludes any Waste Material that DISPOSER has not rightfully revoked its acceptance pursuant to Section 5 hereof.

Examples of Nonconforming Waste Material in a sentence

  • If the alleged nonconformity relates to the chemical composition of the Waste Material and such testing establishes that the Waste Material is not Nonconforming Waste Material or if Aerojet Rocketdyne‘s corrections eliminate the improper containerization, labeling, marking or placarding or Aerojet Rocketdyne agrees to accept Services for such increased fee, then such Waste Material shall be deemed accepted by Disposer and Disposer shall proceed to provide Services with respect to such Waste Material.

  • Aerojet Rocketdyne shall pay Disposer its reasonable expenses and charges for handling and storing any Units of Nonconforming Waste Material, the acceptance of which has been rightfully revoked by Disposer.

  • Disposer did not accept such Nonconforming Waste Material with actual knowledge of the nonconformity.

  • Disposer provides Aerojet Rocketdyne immediate telephonic notice at the time it has discovered a Unit of Nonconforming Waste Material and, within 30 days thereafter, provides Aerojet Rocketdyne a written revocation notice at the Aerojet Rocketdyne location at which the Nonconforming Waste Material was tendered.

  • If Disposer rightfully revokes its acceptance of a Unit of Nonconforming Waste Material, Disposer and Aerojet Rocketdyne shall, in good faith, attempt to amend the applicable Uniform Hazardous Waste Manifest to provide for Services to be performed with respect to any Units of Nonconforming Waste Material.

  • Aerojet Rocketdyne may promptly, after receipt of a revocation notice from Disposer, notify Disposer of Aerojet Rocketdyne’s intent (A) to test such Nonconforming Waste Material to verify the alleged nonconformity, and/or (B) to correct any improper containerization, marking, labeling or placarding.

Related to Nonconforming Waste Material

  • Waste Material means (1) any “hazardous substance” under Section 101(14) of CERCLA, 42 U.S.C. § 9601(14); (2) any pollutant or contaminant under Section 101(33) of CERCLA, 42 U.S.C. § 9601(33); (3) any “solid waste” under Section 1004(27) of RCRA, 42 U.S.C. § 6903(27); and (4) any “hazardous substance” under Wis. Stat. § 292.01.

  • Waste Materials means any Contamination-causing solid, semi-solid, or liquid material discarded, buried, or otherwise present on the Property, and may include sludge, slag, or solid waste materials such as empty containers and demolition debris or materials containing asbestos, lead-based paint, or petroleum or other contaminants.

  • Nonconforming use means a use of land that:

  • Radioactive material means any solid, liquid, or gas which emits radiation spontaneously.

  • Nonconformance as used in this clause means a condition of any hardware, software, material, or service/workmanship in which one or more characteristics do not conform to requirements.

  • Airborne radioactive material means any radioactive material dispersed in the air in the form of dusts, fumes, particulates, mists, vapors, or gases.

  • Nonconforming Goods means only the following: (i) product shipped is different than identified in Buyer's purchase order; or (ii) product's label or packaging incorrectly identifies its contents.

  • Radioactive Products or Waste means any radioactive material produced in, or any material made radioactive by exposure to the radiation incidental to the production or utilisation of nuclear fuel, but does not include radioisotopes which have reached the final stage of fabrication so as to be usable for any scientific, medical, agricultural, commercial or industrial purpose.

  • Bulky Waste means business waste or domestic waste which by virtue of its mass, shape, size or quantity is inconvenient to remove in the routine door-to-door council service provided by the council or service provider;

  • Nonconforming lot means a lot that met dimensional requirements of the applicable master program at the time of its establishment but now contains less than the required width, depth or area due to subsequent changes to the master program.

  • Putrescible waste means a solid waste that contains organic matter capable of being decomposed by microorganisms so as to cause a malodor, gases, or other offensive conditions, or which is capable of providing food for birds and other vectors. Putrescible wastes may form a contaminated leachate from microbiological degradation, chemical processes, and physical processes. Putrescible waste includes, but is not limited to, garbage, offal, dead animals, general household waste, and commercial waste. All solid wastes which do not meet the definitions of inert or chemical wastes shall be considered putrescible wastes.

  • Nonconforming zoning condition means a physical improvement on a property that does not conform with current zoning standards.

  • Nonconforming sign means a sign or sign structure, other than a nonstandard sign or a sign that is erected and maintained in a business area along a scenic byway prior to the designation as a scenic byway, that satisfies 1 of the following:

  • Low-level radioactive waste or “waste” means radioactive material that consists of or contains class A, B, or C radioactive waste as defined by 10 C.F.R. 61.55, as in effect on January 26, 1983, but does not include waste or material that is any of the following:

  • Trade waste means any solid, liquid, or gaseous waste material or rubbish resulting from construction, land clearing for construction or development, building operations, or the prosecution of any business, trade, or industry including, but not necessarily limited to, plastic products, cartons, paint, grease, oil and other petroleum products, chemicals or cinders.

  • Fissile material means the radionuclides uranium-233, uranium-235, plutonium-239, and plutonium-241, or any combination of these radionuclides. "Fissile material" means the fissile nuclides themselves, not material containing fissile nuclides. Unirradiated natural uranium and depleted uranium and natural uranium or depleted uranium, that has been irradiated in thermal reactors only, are not included in this definition. Certain exclusions from fissile material controls are provided in 10 CFR 71.15.

  • Combustible material means combustible refuse, combustible waste or any other material capable of igniting;

  • Nonconformity or “Nonconformities” means any failure or failures of the Software to conform to the requirements of this Contract, including any applicable Documentation.

  • Animal waste means any waste consisting of animal matter that has not been processed into food for human consumption.

  • Special form radioactive material means radioactive material that satisfies the following conditions:

  • Recycled material means any material that would otherwise be a useless, unwanted or discarded material except for the fact that the material still has useful physical or chemical properties after serving a specific purpose and can, therefore, be reused or recycled.

  • Byproduct material means any radioactive material (except Special Nuclear Material) yielded in, or made radioactive by, exposure to the radiation incident to the process of producing or utilizing Special Nuclear Material.
