Nonqualified bonds definition

Nonqualified bonds means the portion of the outstanding bonds in an amount that, if the remaining bonds were issued on the date on which the deliberate action occurs, the remaining bonds would not satisfy the private business use test or the private loan financing test, as applicable. The amount of private business use is the highest percentage of business use in any one-year period, commencing with the deliberate action.
Nonqualified bonds means the portion of the outstanding BPCA Bonds in an amount that, if the remaining BPCA Bonds were issued on the date on which the Private Activity Test or the Private Loan Test is met, neither of such tests would be met (i.e., the aforementioned 10% or 5% limitation or the $15,000,000 limitation would not be exceeded) and the Private Loan Test (i.e., the aforementioned 5% or $5,000,000 limitation would not be exceeded).
Nonqualified bonds means the portion of the outstanding Bonds in an amount that, if the remaining Bonds were issued on the last day of the Expenditure Period, all of the Available Project Proceeds of the remaining Bonds would have been used for Qualified Purposes within the Expenditure Period.
