The Subcontractor will provide to NW P, a listing of all employees who will need access to the WIPP Site or other satellite facilities.

If the Subcontractor considers the Order to be consistent with the other terms of the Subcontract, it can be implemented within existing funds, labor, and other provisions of the Subcontract, and the implementation will not have a negative impact on the cost, schedule, or other obligations of the Subcontractor, the Subcontractor shall establish an implementation schedule, and so advise the Contracting Officer, through NW P, within thirty (30) calendar days of receipt.
The Buyer is the only NW P official authorized to resolve possible conflicting requirements involving them.
Before commencing the work, the Seller shall meet with a representative(s) of NWP to discuss and develop a mutual understanding relative to the administration of the overall work safety program under the Subcontract to accommodate the additional work, heeding any direction that may be provided by NW P.
In the event that the Seller fails to comply with said regulations or requirements of the NW P, the Buyer may, without prejudice to any other legal or contractual rights of the NWP, issue an order stopping all or any part of the work; thereafter, a start order for resumption of the work may be issued at the discretion of the NWP.
