Audit costs shall include, but shall not be limited to, the fees of the OCIP Administrator, and the fees of attorneys and accountants conducting the audit and review.
Where permitted by law, Design-Builder hereby waives all rights of recovery by subrogation because of deductible clauses, inadequacy of limits of any insurance policy, limitations or exclusions of coverage, or any other reason against Trustees, the OCIP Administrator, their officers, agents, or employees, and any other contractor or subcontractor performing Work or rendering services on behalf of Trustees in connection with the planning, development and construction of the Project.

All Contractors and Subcontractors shall be enrolled in the OCIP through the OCIP Administrator.
The Enrollment process is defined by the policy and detailed through documents which will be made available by the OCIP Administrator.
Contractor shall hold Owner, the OCIP Administrator and their representatives, including, but not limited to, insurance brokers and/or agents, free and harmless from any and all claims asserting or alleging that the type and/or amount of coverage provided under the Program is inadequate, deficient, insufficient, or in any way not providing the nature and amount of coverage that might at a later date be deemed or claimed to be appropriate.
The Contractor shall supply to the OCIP Administrator and/or Owner Certificates of Insurance (COI) for the insurance policies described in this exhibit prior to the commencement of the Work and before bringing any equipment or construction personnel onto the Project site.
The Contractor shall conduct a preconstruction conference with the subcontractors, Architect, Inspector of Record, AOC Project Manager, OCIP Administrator (if elected by AOC) and other appropriate persons.
There are no representations regarding the nature, quality or limits of the Program policies and Contractor expressly acknowledges the lack of reliance upon any representations made by Owner, other Contractors, Subcontractors, the OCIP Administrator or their representatives regarding the nature, quality or limits of the insurance provided by the Program.
Any contractor/subcontractor’s failure to comply with the OCIP Administrator and all OCIP requirements shall be considered non-compliant under the contract.Enrollment of each Contractor’s eligible Subcontractors is mandatory.
