OEM Product definition

OEM Product means a hardware or software product developed, manufactured or distributed, or any of the foregoing, by Licensee for distribution, directly or indirectly, to end users.
OEM Product means any product developed by OEM into which the Licensed Software is to be incorporated to create a Bundled Product.
OEM Product means: (i) a Digital Satellite Receiver that: (a) is manufactured by or on behalf of ETLLC; (b) is branded with an Approved OEM Brand Name; (c) is designed to be compatible only with the DISH Network; and (d) after being equipped with a Smart Card is designed to be unable to receive, decode or descramble signals transmitted by satellite transponders that are not owned, leased, or controlled by Licensee or an Affiliate of Licensee; (ii) a Sling Product; or (iii) a Digital Converter Box. For clarity and the avoidance of doubt, a Digital Satellite Receiver which is specifically designed for a third party other than Licensee or an Affiliate of Licensee shall not be considered an OEM Product.

  • You must include a legitimate and unique license key into every OEM Product prior to making it available to end customers.

OEM Product means: (i) any Digital Satellite Receiver that: (a) is manufactured by or on behalf of ETLLC; (b) is branded with an Approved OEM Brand Name; (c) is designed to be compatible only with the DISH Service; and (d) after being equipped with a Security Access Device is designed to be unable to receive, decode or descramble signals transmitted by satellite transponders that are not owned, leased, or controlled by Licensee or an Affiliate of Licensee; (ii) a Sling Product; (iii) a Digital Converter Box; or (iv) Accessories. For clarity and the avoidance of doubt, a Digital Satellite Receiver which is specifically designed for a third party other than Licensee or an Affiliate of Licensee shall not be considered an OEM Product.
OEM Product means a fully functional version of the Licensed Product used to bundle with OEM partners, and shall expressly include Updates and expressly exclude Upgrades of the Licensed Product. The level of functionality of any OEM Product shall be determined in good faith by FalconStor and Network-1 in advance of any OEM Transaction.
OEM Product means a product that (Y) consists of both hardware and software components, including executable only versions of the Licensed Materials, or any derivative thereof, that execute solely and exclusively on TI Devices and not on devices manufactured by or for an entity other than TI, and (Z) is sold by or for an original equipment manufacturer (“OEM”) bearing such OEM brand name and part number.
OEM Product a product technically identical to an existing product but due to a cosmetic change of the look-and-feel of the product and/or its packaging, and/or its software user interface, that such cosmetically changed product appeals to be a product originating from Customer.
OEM Product collectively means OEM Display Product and OEM Derivative Product.
OEM Product means a software product bundled together with a computing hardware or another software product and marketed as a single product by an Original Electronic Manufacturer, or sometimes also referred to as an “appliance” when it’s bundled with a hardware.
OEM Product means any Customer product that integrates the Product, which resides permanently therein, in accordance with the terms and conditions of the Agreement.
