The Local Government must maintain, for a period of at least five years, records of Opioid Settlement Fund expenditures and documents underlying those expenditures, so that it can be verified that funds are being or have been utilized in a manner consistent with the National Settlement Agreement, any Bankruptcy Resolutions, and this MOA.
The Lead State Agency will engage in oversight and audits of projects and programs funded through the Opioid Settlement Fund.
Each New York Subdivision that receives funds from the Opioid Settlement Fund under this Agreement will annually provide to the Lead State Agency and Advisory Board a detailed accounting of the spending of such funds as well as analysis and evaluation of the projects and programs it has funded.
This report shall be provided on or before November 1 of each year, beginning one year after the initial deposit of monies in the Opioid Settlement Fund.
Funds will be deposited into the State- Directed Opioid Settlement Fund after payment of attorney’s fees and costs to the State’s outside counsel as provided in Section C.
On or before November 1 of each year, beginning November 1, 2021, the Advisory Board shall issue a written report of recommendations regarding specific opioid abatement priorities and expenditures from the Opioid Settlement Fund for Approved Uses.
The budget includes $296.5 million in 2022-23, $370.5 million in 2023-24 and 2024-25 from the General Fund and the Opioid Settlement Fund to administer and support this program.
