Should the Contractor fail so to inspect and report, he shall have no claim against the Owner because of the defective or unfinished Work of any Other Contractor, except due to latent defects not reasonably noticeable at the time of the commencement of the Contractor's work.
If any part of the Contractor's work depends for its proper execution or results upon the work of another contractor, the Contractor shall report promptly to the Engineer any defects in the work of such Other Contractor that may interfere with the proper execution of the Contractor's work.
If such Other Contractor sues the Owner on account of any damage alleged to have been so sustained, the Owner shall notify the Contractor, who shall defend such proceedings at his own expense; and if any judgement against the Owner arises therefore, the Contractor shall be responsible and pay the amount of such judgement and all costs incurred by the Owner.
The Employer's Agent, the Contractor and the Other Contractor (acting reasonably) shall agree an access regime which shall describe the extent and location of and other relevant matters relating to (without limitation) any works, outstanding works to be completed, access, delivery of materials or use (including programme and arrangements for the co-ordination of activities on site of the project) before and/or during work to be undertaken by the Contractor.
