Participating Builder definition

Participating Builder means any person or entity which acquires any portion of the Properties from the Declarant for the purpose of constructing improvements for sale to consumers or who purchases for development and resale in the ordinary course of its business.

Participating Builder means and refer to D.R. Horton, Inc., a Delaware corporation, and any affiliate of D.R. Horton, Inc., and any other entity(ies) Declarant may designate as a Participating Builder. Declarant shall have the right to assign, in whole or in part, any of its rights hereunder to a Participating Builder(s). “Participating Builders” shall mean Participating Builder and any other entity(ies) designated as a Participating Builder.
