PARTICIPATION IN THE SPORT definition

PARTICIPATION IN THE SPORT means launching/kiting (and/or assisting another in launching/kiting), flying (whether as pilot in command or otherwise) and/or landing (including, but not limited to, crashing) a hang glider or paraglider.

• If I am the parent or legal guardian of Participant, I AGREE TO INDEMNIFY AND REIMBURSE the RELEASED PARTIES for their defense and indemnity from any claim or liability in the event that Participant suffers SPORTS INJURIES as a result of Participant’s PARTICIPATION IN THE SPORT, even if caused in whole or in part by the action, inaction or negligence (whether active or passive) of any of the RELEASED PARTIES, to the fullest extent allowed by law.

• If Participant is under 18 years of age, the term “SPORTS INJURIES” means personal injury, bodily injury, death, property damage and/or any other personal or financial injury sustained by Participant as well as personal injury, bodily injury, death, property damage and/or any other personal or financial injury sustained by Participant’s parents or legal guardians, as a result of Participant’s PARTICIPATION IN THE SPORT and/or as a result of the administration of any USHPA programs.

• I VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN, OF PERSONAL INJURY, BODILY INJURY, DEATH OR PROPERTY DAMAGE CONNECTED WITH MY PARTICIPATION IN THE SPORT OF TREKKING HOWSOEVER CAUSED, EVEN IF CAUSED IN WHOLE OR PART BY THE ACTION, INACTION, OR NEGLIGENCE OF THE RELEASED PARTIES.

• DESPITE THE RISKS INVOLVED AND IN CONSIDERATION OF THE RIGHT TO PARTICIPATE IN THE SPORT, I FULLY AND VOLUNTARILY ACCEPT ANY AND ALL RISKS OF INJURY, DEATH, OR DAMAGE TO PROPERTY THAT MIGHT BE ASSOCIATED WITH MY PARTICIPATION IN THE SPORT OR USE OF THE FACILITIES EVEN IF INJURIES, DEATH OR DAMAGE TO PROPERTY OCCUR IN A MANNER THAT IS NOT FORESEEABLE AT THE TIME I SIGN THIS AGREEMENT.

• OAK MOUNTIAN, LLC., THEIR OWNERS, AFFILIATES, SUBSIDIARIES, EMPLOYEES AND AGENTS AND ALL OF THEIR OFFICERS AND DIRECTORS AND THE SPONSORS AND DISTRIBUTORS AND THEIR SUCCESSORS INTEREST (HEREINAFTER INDIVIDUALLY AND COLLECTIVELY IN ALL COMBINATIONS "RELEASES" OR "INDEMNIFIED PARTIES") FOR ANY PERSONAL INJURY, DEATH OR PROPERTY DAMAGE THAT MAY OCCUR AS A RESULT OF MY PARTICIPATION IN THE SPORT OF SKIING, PARTICIPATION IN SKI SCHOOL, AND /OR MY USE OF THE FACILITIES AT OAK MOUNTAIN, LLC.

PARTICIPATION IN THE SPORT means Preparing for, Taking Off, Flying and/or Landing (including, but not limited to, Crashing) (whether as Member in command or otherwise) (and/or assisting another in Preparing for, Taking Off, Flying and/or Landing), an Ultralight Vehicle.

PARTICIPATION IN THE SPORT means engaging in the sport of POWER KITING, and includes all activities involving the setup, use and breakdown of POWER KITING equipment, and further includes the giving or receiving of assistance or instruction in the sport of POWER KITING.

PARTICIPATION IN THE SPORT means launching/kiting (and/or assisting another in launching/kiting), flying (whether as pilot in command or otherwise) and/or landing (including, but not limited to, crashing) an ultralight vehicle.

PARTICIPATION IN THE SPORT means engaging in the sport of Kitesurfing / Kiteboarding, Windsurfing, Kite foiling and/or Wing foiling and includes all activities involving the setup, use and breakdown of the equipment, and further includes the giving or receiving of assistance or instruction in the sport of Kitesurfing / Kiteboarding, Windsurfing, Kite foiling and/or Wing foiling.

PARTICIPATION IN THE SPORT means all training activities including launching (and/or assisting another in launching), flying (whether as pilot in command or otherwise) and/or landing (including, but not limited to, crashing) a paraglider.

PARTICIPATION IN THE SPORT means skateboard riding (and/or assisting another in riding), skateboard racing and other activities immediately associated with the skateboard race event (including, but not limited to: officiating, timing, course-setting, spectating, coaching, etc).

PARTICIPATION IN THE SPORT means launching/kiting (and/or assisting another in launching/kiting), flying (whether as pilot in command or otherwise) and/or landing (including, but not limited to, crashing) a hang glider or paraglider. A speed wing or mini wing is a form of paraglider.
