Phase 2 Facilities definition

Phase 2 Facilities means all of Phase 1 Facilities, plus (ii) the construction of a building (“the Building”) containing approximately 2,500 square feet of space under roof to be constructed on the Land generally south of Lake Tye as shown on the Phase 2 Concept Plan and containing a retail and pro shop area, ticket sales booth, rental area, private office space, restrooms and reception area to replace the temporary building, temporary storage container and temporary restroom facilities in Phase 1; (iii) eight (8) cable wakeboard tower systems; (iv) purchase and installation of lake obstacles, including ramps, jumps and rails; (v) a full starting dock, including seating areas, covered viewing areas, walkways and landscaping; (vi) pedestrian bridge; (vii) expansion and construction of additional parking to enhance the existing parking capacity on the Land to at least 20 new parking spaces; and (viii) landscaping, irrigation, and other improvements to be constructed on the Land more fully described in a submittal (the "Phase 2 Facilities Plan") filed and approved by the City (the "Facilities Plan").

Examples of Phase 2 Facilities in a sentence

  • Concessionaire shall obtain approval of the Phase 2 Facilities and Site Concept Plan by the City prior to the submission of any construction plans for the Phase 2 Facilities.

  • In no case shall the approval of the Phase 2 Facilities and Site Concept Plan be deemed a modification or amendment of this Agreement.

  • The Phase 2 Facilities and Site Concept Plan shall be in conformance with this Agreement.

  • If the City has objections to the Phase 2 Facilities and Site Concept Plan as submitted, the City shall note such objections in writing and Concessionaire shall cause the Phase 2 Facilities and Site Concept Plan to be revised to address such objections and shall re-submit the revised Phase 2 Facilities and Site Concept Plan to the City for approval within seven (7) calendar days.

  • The Phase 2 Facilities and Site Concept Plan as approved by the City shall be deemed a part of this Agreement without the necessity of further amendment.

  • The Phase 2 Facilities Plan as approved by the City shall be deemed a part of this Agreement without the necessity of further amendment.

  • In no case shall the approval of the Phase 2 Facilities Plan be deemed a modification or amendment of this Agreement.

  • The parties mutually acknowledge that: (i) installation of the Phase 2 Facilities is a critical component of the consideration under this Agreement; (ii) it would be extremely difficult or impracticable to quantify the actual damages to the City in the event that Concessionaire fails to complete construction of the Phase 2 Facilities by the deadline established herein; and (iii) the amount of liquidated damages set forth in this subsection is a reasonable estimate of such actual damages.

  • As in the previous paragraph, a similar process shall occur if and when Concessionaire submits its Phase 2 Facilities Plan to the City.

  • The Phase 2 Facilities Plan shall be in conformance with this Agreement.

Related to Phase 2 Facilities

  • New Facilities means facilities for which, by the cut-off date, neither of the following events has occurred:

  • Generating Facilities means Interconnection Customer’s device for the production and/or storage for later injection of electricity identified in the Interconnection Request, but shall not include the Interconnection Customer’s Interconnection Facilities. Generation Interconnection Customer:

  • Production Facilities (7 9) means "production equipment" and specially designed software therefor integrated into installations for "development" or for one or more phases of "production".

  • Public facilities means amenities that are—

  • Existing Facilities means all existing buildings and other facilities, the sites for the buildings or facilities, and furnishings or equipment for the buildings or facilities located on real property acquired by the building authority under the terms of this act.

  • Related facilities means any ancillary facilities owned by the Company which are —

  • Wastewater facilities means the structures, equipment, and processes required to collect, carry away, and treat domestic and industrial wastes and dispose of the effluent.

  • Project Facilities means any facilities to be constructed, provided, rehabilitated, operated and/or maintained under the Project;

  • Idle facilities means completely unused facilities that are excess to the governmental unit's current needs.

  • Generating Facility means the Generating Unit(s) comprising Seller’s power plant, as more particularly described in Section 1.02 and Exhibit B, including all other materials, equipment, systems, structures, features and improvements necessary to produce electric energy and thermal energy, excluding the Site, land rights and interests in land.

  • Interconnection Facilities means the Transmission Owner Interconnection Facilities and the Customer Interconnection Facilities.

  • Common Facilities means the facilities under D.G.sets/D.G.rooms, water storage tanks its pumping and supply system, sewerage & drainage systems, electric sub-station/ transformers/electric panels/distribution network, maintenance service rooms, lawns including lighting & services etc., roads, pathways & driveways including street lighting & services etc., guard posts, fire hydrants & fire fighting system etc. and all such facilities and areas for common use and excluded from the computation of Super Area of the Said Premises;

  • Generation Interconnection Facilities Study means a Facilities Study related to a Generation Interconnection Request.

  • Railroad facilities means right of way and related

  • Other Facilities means athletic stadiums, swimming pools, any associated structures or related equipment tied to such facilities including, but not limited to, grandstands and night field lights, greenhouses, facilities used for non-instructional or non-educational purposes, and any structure, building, or facility used solely for school administration;

  • Shared Facilities means the gentie lines, transformers, substations, or other equipment, permits, contract rights and obligations, and other assets and property (real or personal), in each case, as necessary to enable delivery of energy from Seller’s electric generating facility (which is excluded from this definition of Shared Facilities) to the Point of Interconnection that are used in common with other entities, as applicable.

  • Parking Facilities means parking lots or other off-street areas for the parking of vehicles, including areas below or above the surface of streets.

  • Public facility means 1 or more of the following:

  • generation facility means a facility for generating electricity or providing ancillary services, other than ancillary services provided by a transmitter or distributor through the operation of a transmission or distribution system, and includes any structures, equipment or other things used for that purpose;

  • LNG facility means a terminal which is used for the liquefaction of natural gas or the importation, offloading, and re-gasification of LNG, and includes ancillary services and temporary storage necessary for the re-gasification process and subsequent delivery to the transmission system, but does not include any part of LNG terminals used for storage;

  • Additional Facilities has the meaning assigned to that term in Section 2.9(a).

  • Project Facility means facility being one or more of the following facilities as specified in the Special Conditions of Contract, being developed in accordance with the Project and the Detailed Project Implementation Report and includes all its buildings, equipment, facilities, software and systems and includes without limitation, where the circumstances so require, any expansion thereof from time to time and may include any new location to be separately mentioned in the Special Conditions of Contract.

  • Bank Facilities means any overdraft limits or credit facility available to you and their associated terms;

  • Cogeneration facility means a power plant in which the heat or steam is also used for industrial or commercial heating or cooling purposes and that meets Federal Energy Regulatory Commission standards for qualifying facilities under the Public Utility Regulatory Policies Act of 1978 (16

  • Marijuana testing facility means an entity licensed to analyze and certify the safety and potency of marijuana.

  • Redevelopment Area means the community redevelopment area described, defined or otherwise identified or referred to in the Redevelopment Plan.
