Phase II Land definition

Phase II Land means that portion of the Project Site designated as the Phase II Land in the Collateral Documents, together with all improvements thereon and all rights appurtenant thereto.

Phase II Land means the approximately 20-acre tract of land upon which the Phase II Project may be built, as more particularly described in Exhibit T-4 to the Disbursement Agreement.

Phase II Land means the real property consisting of approximately 14 acres of the Real Estate Contribution as described in more detail in Exhibit T-5 of the Disbursement Agreement together with all improvements thereon.

Examples of Phase II Land in a sentence

• The particulars of the title of the Whole Project Land and Phase II Land (defined hereinafter) are more fully described in Part – V of the Schedule A hereto (hereinafter referred to as “the Devolution of Title”).

• If there are any existing local improvements or other rates or charges in respect of the Phase II Land, including any that relate to the construction, maintenance and repair of municipal drains, the Subdivider shall commute and repay same within ten (10) days after the execution and delivery of this Agreement by the Municipality.

• The Subdivider shall pay all taxes, including all water and sewer rates and assessments, levied on the Phase II Land in accordance with the assessment thereof until the Phase II Land has been assessed according to the Phase II Plan, after which, the Subdivider shall pay the taxes levied on any and all lots which the Subdivider continues to own, whether municipal tax exempt or not, of which the Municipality is the owner.

• The covenants, agreements, conditions and undertaking herein contained on the part of the Subdivider shall run with the Phase II Land and shall be binding upon the Subdivider and upon its successors and assigns, as owners and occupiers of the Phase II Land, from time to time and shall be appurtenant to the adjoining highways in the ownership of the Municipality; and this Agreement shall ensure to the benefit of and be binding upon the Municipality and its successors and assigns.

• As at the date of signing of the Phase II Subdivision Agreement and as of the date of registration of the Phase II Subdivision Agreement against the Phase II Land, 1960634 Ontario Inc.

More Definitions of Phase II Land

Phase II Land means the approximately 20-acre tract of land adjacent to the Le Rêve hotel and casino resort owned by Valvino, as more particularly described in Exhibit T-4 to the Disbursement Agreement.

Phase II Land shall have the meaning ascribed to such term in Recital M of this Agreement; (bb) “Possession Date” shall have the meaning ascribed to such term in Clause 38.7 of this Agreement;

Phase II Land means the portion of Project Land admeasuring 12361.1 sqm. (133005.43 sq. ft.)

Phase II Land shall have the meaning ascribed to such term in Recital XIII of this Agreement;

Phase II Land means that portion of the Land identified on the Site Plan as Phase II and on which the Phase II Improvements are to be constructed as provided in this Agreement.

Phase II Land means that certain parcel of land owned by Landlord, upon which the Building and Parking Deck will be constructed, and more particularly described on Exhibit A-2 to this Lease.

Phase II Land means the real property consisting of approximately 14 acres adjoining the land containing the Phase I Project and the Phase I-A Project owned by the Phase II Subsidiary.
