Pollution Incident definition

Pollution Incident means an occurrence or series of occurrences having the same origin, which results or may result in a discharge of oil and/or hazardous and noxious substances and which poses or may pose a threat to the marine environment, or to the coastline or related interests of one or more States, and which requires emergency action or other immediate response;
Pollution Incident means a discharge of any Hazardous Material to the Environment in breach of any Applicable Laws;
Pollution Incident means the occurrence of pollution within the meaning of sections 39(1), 41(1) and 45(1) of the Environment Protection Act 1970 (Vic).

  • The Owner must indemnify Port of Melbourne for direct and indirect losses incurred by Port of Melbourne arising from any Pollution Incident, Environmental Hazard or Contamination caused by the Owner, the Shipping Agent, or their servants, agents, employees or contractors, including all crew and all personnel engaged by it in relation to a Vessel without prejudice to any defences, exclusions from liability and rights of limitation provided by law.

More Definitions of Pollution Incident

Pollution Incident means emission, discharge, release or escape of "pollutants" into or upon land, the atmosphere, or any watercourse or body of water, provided that such emission, discharge, re- lease or escape results in "environmental dam- age". The entirety of any such emission, dis- charge, release or escape shall be deemed to be one "pollution incident".
Pollution Incident means an incident or set of circumstances during or as a consequence of which there is or is likely to be a leak, spill or other escape or deposit of a substance, as a result of which pollution has occurred, is occurring or is likely to occur. It includes an incident or set of circumstances in which a substance has been placed or disposed of on premises, but it does not include an incident or set of circumstances involving only the emission of any noise.

Pollution Incident means the actual or alleged discharge, dispersal, seepage, migration, or escape of smoke, vapor, fumes, acids, alkalis, chemicals, asbestos, liquid or gases, waste materials or other irritants, contaminants or pollutants into or upon the land, atmosphere or any watercourse or body of water, and caused by the Insured’s activities for others or by any entity or person that the Insured is legally liable for. Waste materials include materials to be recycled, reconditioned or reclaimed.
