Priority 2 Defect definition

Priority 2 Defect means any Defect in the Product that (a) causes Customer’s network or environment to be severely degraded, (b) causes significant aspects of Customer’s business operation to be negatively affected, or (b) has a CVSS v3 score of 4 – 8.4 for any reported security vulnerability.
Priority 2 Defect means a Defect that is not a Priority 1 Defect and that causes (A) significant restrictions on, significant disruption of, or significant adverse impact on Licensee’s business operations making use of the Software; or (B) inability to access or use a non-trivial function of the Software. Using commercially reasonable efforts, Licensor shall (X) within one (1) week after submission of the Defect Report, assign fully qualified technicians to repair the Defect; (Y) provide a workaround within one (1) calendar month; and (Z) supply a Correction as soon as possible.
Priority 2 Defect means an incident where the State’s Software or Processing Error that results in a partial or intermittent system outage or unavailability, performance items that result in undue delay of processing business cycle data and creation of a processing backlog, System performance and availability levels not adhering to agreed-upon SLAs, the State’s traditional performance levels, and generally accepted and customary industry standards for similar functions or capabilities, a temporary workaround identified but due to processing, hardware, labor or other considerations is deemed unreasonable by the State, or may be a recurring issue with identified or indeterminate cause.
