Other Considerations. A. Changes to an Approved Scope of Work: The Recipient shall notify FEMA and shall require a sub-recipient to notify it immediately when a sub-recipient proposes changes to an approved scope of work for an Undertaking.
1. If FEMA determines the change meets a Programmatic Allowance or has no effect on the property, FEMA shall approve the change.
2. If the change can be modified to meet a Programmatic Allowance, or conform to any applicable SOI Standards, FEMA shall conclude its Section 106 review responsibilities.
3. If FEMA determines that the change does not meet an Allowance, FEMA shall initiate consultation pursuant to Stipulation II.C, Standard Project Review.
B. Unexpected Discoveries, Previously Unidentified Properties, or Unexpected Effects:
1. Upon notification by a sub-recipient of an unexpected discovery, or if it appears that a Undertaking has affected a previously unidentified property or affected a known historic property in an unanticipated manner, in accordance with Stipulation I.B.3(e), Recipient Roles and Responsibilities, the Recipient shall immediately notify FEMA and require the sub-recipient to:
a. Stop construction activities in the vicinity of the discovery.
b. Take all reasonable measures to avoid or minimize harm to the property until FEMA has completed consultation with the SHPO, and any other consulting parties. Upon notification by the Recipient of a discovery, FEMA shall immediately notify the SHPO, and other consulting parties that may have an interest in the discovery, previously unidentified property or unexpected effects, and consult to evaluate the discovery for National Register eligibility and/or the effects of the Undertaking on historic properties.
c. If human remains are discovered, notify the local law enforcement office and coroner/medical examiner in accordance with applicable Commonwealth statute(s), and protect the remains from any harm. Notify the SHPO within twenty- four (24) hours of identifying human remains.
d. Assist FEMA in completing the following actions, as required:
i. FEMA shall consult with the SHPO and other consulting parties in accordance with the consultation process outlined in Stipulation II, Project Review, to develop a mutually agreeable action plan with timeframes to identify the discovery or previously unidentified property, take into account the effect(s) of the Undertaking, resolve adverse effect(s) if necessary, and ensure compliance with applicable Federal, State, and local statutes.

Other Considerations. A. During the period of tenure-earning service, the employee's employment shall be governed by the provisions of Article 12.
B. Part-time service of an employee employed at least one semester in any twelve (12) month period shall be accumulated. For example, two (2) semesters of half-time service shall be considered one-half year of service toward the period of tenure-earning service.
C. Where employees are credited with tenure-earning service at the time of initial appointment, all or a portion of such credit may be withdrawn once by the employee prior to formal application for tenure.
Other Considerations. During the first day and any second consecutive day of absence, an employee utilizing sick leave shall be available for contact during the employee’s regular shift hours unless otherwise authorized by the Chief in writing. After a second consecutive day of sick leave, during continued absence utilizing sick leave, the employee must be at home so that the employee may be contacted during the hours of 8:00 a.m. to 4:00 p.m. Monday through Friday unless hospitalized, receiving out-patient medical treatment outside the employee’s residence, purchasing required medication, or as authorized in writing by the Chief.
Other Considerations. (a) During the period of tenure-earning service, the employee may be issued a notice of non-reappointment.

Other Considerations. 1. No unit member new to the district will be employed until all unit members on the callback list have been reassigned. Exceptions to this will occur when there is no unit member on the callback list certified/licensed for a vacancy or when all unit members on the callback list reject a vacancy.
2. Suspended unit members shall have the right to pay premiums for hospitalization, dental and other insurance benefits as per the provisions of C.O.B.R.A. for a period of eighteen (18) months following the effective date of suspension. Group life insurance coverage may be continued at the member’s expense in accordance with the District’s life insurance policy in effect at the time.
3. During a period of suspension, a unit member’s seniority with the district will be continued; however, a unit member will not be granted experience credit on the salary schedule for the period of time the contract is suspended.
4. A unit member whose contract expires during a period of the contract suspension because of a RIF will be eligible for contract renewal as follows:
a. A unit member who is suspended for the duration of the contract and who teaches less than one (1) semester on the contract will have his/her contract renewed for the same length as the expiring contract.
b. A unit member who teaches more than one (1) semester during a contract and is suspended for the balance will be eligible for contract renewal pursuant to the District evaluation procedures.
5. The parties agree that these procedures apply only to the suspension of contracts as provided under Ohio Revised Code 3319.
Other Considerations. 4.16.2.1 An adjustment to a paid Claim shall not be counted as a Claim for the purposes of reporting.
4.16.2.2 Electronic Claims shall be treated as identical to paper-based Claims for the purposes of reporting.
Other Considerations. Except as provided herein, nothing in this agreement shall be construed as obligating the other party to expend funds or obligate future payment of money authorized by law and administratively available for this work.
Other Considerations. During the period of tenure-earning service, the Faculty Member’s employment will be governed by the provisions of Article 13 (Non-Reappointment). Part-time service of a Faculty Member employed at least one (1) Semester in any twelve (12) month period will be accumulated. For example, two (2) Semesters of half-time service will be considered one-half (1/2) Year of service toward the period of tenure- earning service. Where Faculty Members are credited with tenure-earning service at the time of initial appointment, all or a portion of such credit may be withdrawn once by the Faculty Member prior to formal application for tenure.
Other Considerations. 1. The District may assign another evaluator(s) to review the performance of a teacher at any time during the evaluation process. A teacher proposed for a Remediation Plan has the right to request and be given a second evaluation by a different District evaluator prior to the implementation of the Remediation Plan. The District evaluator will be selected by the teacher from a list of fifteen (15) evaluators generated by the Executive Director of Human Resources. This list will be updated for each selection.
2. All forms adopted by the Board as a part of this procedure are made a part of this Agreement and are subject to the provisions herein.
