Private Security Sector definition

Private Security Sector means the sector in which employers and employees are associated for the purpose of guarding or protecting fixed property, premises, goods, persons or employees, including monitoring and responding to alarms at premises which are guarded by persons or by electronic means;
Private Security Sector means the Industry in which the EMPLOYERS and their employees are associated on fixed term or fixed projects contracts, as governed by SECTORAL DETERMINATION 3: Private Security Sector, South Africa.
Private Security Sector means the sector in which employers and employees are associated for the purpose of guarding or protecting fixed property, premises, goods, persons or employees, including monitoring and responding to alarms at premises which are guarded by persons or by electronic means. The provisions of this determination shall not apply – to a manager as defined in clause 2(28); or to any employer or employee who is subject to an agreement of a bargaining council in terms of the Labour Relations Act, 1995. For the purposes of determining the wage rate applicable to an employee, the area where the employee performs the employer’s duties shall be the area contemplated in clause 3 sub clause (1) irrespective of whether or not the employer has an establishment in that area. Subject to the provisions of the National Keypoint Act, 1980, this determination shall also apply to employers and employees who provide security services at National Key Points. Definitions For the purposes of this determination, unless the context otherwise indicates, any expression used herein which is defined in the Basic Conditions of Employment Act, No. 75 of 1997, has the same meaning as in that Act and an employee shall be deemed to be in that class in which the employee is wholly or mainly engaged.
