Protective care may also be imposed on a child who, at the time of the act, was under 15 years of age, if justified by the nature of the act which would otherwise be a criminal offence and if necessary to ensure their proper upbringing.
Protective care (ochranná výchova) is a protective measure under Section 21 of Act No 218/2003 on juvenile courts.
It is not imposed on the child for a determined period of time, but it lasts “as long as its objective requires so”.14 The only limit of its duration is thus the age of the child since the protective care ends, in principle when the child reaches majority.15 Protective care is therefore a custodial measure with undetermined duration.
