Provisional Financial Settlement definition

Provisional Financial Settlement means the process during which CMS compares the ACO’s provisional Performance Year Benchmark to the ACO’s provisional Performance Year expenditures to determine the amount of provisional Shared Savings or Shared Losses in accordance with Section 12.04 and Appendix B and calculates the provisional net amount owed by either CMS or the ACO for the Performance Year. Provisional Financial Settlement is available for selection by the ACO for Performance Year 2023 and each subsequent Performance Year as described in Section 8.01. Provisional Financial Settlement will be followed by Final Financial Settlement.
Provisional Financial Settlement means the process during which CMS compares the DCE’s provisional Performance Year Benchmark to the DCE’s provisional Performance Year expenditures to determine the amount of provisional Shared Savings or Shared Losses in accordance with Section 12.04 and Appendix B, and calculates the provisional net amount owedby either CMS or the DCE for the Performance Year, and if the DCE’s first Performance Year is Performance Year 2021, calculates the provisional amount of Other Monies Owed. Provisional Financial Settlement will apply for Performance Year 2021 and is available for selection by the DCE for Performance Year 2022 and each subsequent Performance Year as described in Section8.01. Provisional Financial Settlement will be followed by Final Financial Settlement.

Examples of Provisional Financial Settlement in a sentence

  • For the relevant Performance Year, CMS will provide preliminary, interim, provisional (if the ACO selected Provisional Financial Settlement), and final data to the ACO detailing the ACO’s Performance Year Benchmark throughout the Performance Year, as detailed in Sections 11.01.B, 11.01.C, and 12.04.A.2, if applicable, and 12.04.A.3, respectively.

  • Cash Settlement shall have the meaning specified in Section 14.02(a).

  • Structured settlement obligor means, with respect to any structured settlement, the party that has the continuing obligation to make periodic payments to the payee under a structured settlement agreement or a qualified assignment agreement.

  • Viatical settlement provider means a person, other than a viator, who enters into or effectuates a viatical settlement contract. Viatical settlement provider does not include:

  • Disruption Cash Settlement Price means in respect of each Security, an amount in the Settlement Currency equal to the fair market value of the Share Amount (taking into account, where the Settlement Disruption Event affected some but not all of the Shares comprising the Share Amount and such non-affected Shares have been duly delivered as provided above, the value of such Shares), less the cost to the Issuer of unwinding any underlying related hedging arrangements, all as determined by the Issuer.

  • Structured settlement payment rights means rights to receive periodic payments under a structured settlement, whether from the structured settlement obligor or the annuity issuer, where:

  • Cash Settlement Amount means the “Cash Settlement Amount” as determined by the Calculation Agent in accordance with Paragraph 6.

  • Individual Settlement Payment means the amount payable from the Net

  • Retail Settlement Code means the code approved by the Board and in effect at the relevant time, which, among other things, establishes a distributor’s obligations and responsibilities associated with financial settlement among retailers and customers and provides for tracking and facilitating customer transfers among competitive retailers;

  • Net Settlement Fund means the Settlement Fund, plus accrued interest, less any award of attorneys’ fees or reimbursement of expenses and less applicable taxes, tax preparation expenses, and costs of notice and administration, that may be awarded or approved by the Court.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.

  • Structured settlement agreement means the agreement, judgment, stipulation, or release embodying the terms of a structured settlement.
