EU Regulation 178/2002 lays down the general principles and requirements of food law and procedures in matters of food safety.

General principles such as the precautionary principle are set out in the European Union (EU)’s General Food Law Regulation 178/2002.
Article 14(6) of Regulation 178/2002 stipulates that where “any food which is unsafe forms part of a batch, lot, or consignment of food of the same class or description, it shall be presumed that all the food in that batch, lot or consignment is also unsafe, unless following a detailed assessment there is no evidence that the rest of the batch, lot or consignment is unsafe”.
The decision to prosecute for Regulation 178/2002 Article 14 or Food Safety Act section 7 or 14 offences relating to the sale of food injurious to health or unfit for human consumption, or not of the quality demanded by the purchaser will be taken at the earliest opportunity to avoid unnecessary and time consuming investigations by both authorised officers and food businesses.
The Food Regulation 178/2002 is amended to exclude medical devices from its scope (see3.1. above).
As explained in relation to Article 17, Regulation 178/2002 has no incidence on the legal national systems regulating the liability of the operators (civil, criminal liability).
The Agency is specified as an additional enforcement authority in relation to Articles 14 and 19 to allow, for example, for the flexibility of the Meat Hygiene Service enforcing Regulation 178/2002 requirements in meat plants, where this would be more effective.
They concern: • products that contain or consist of viable biological substances (e.g. living micro- organisms); • food covered by Regulation (EC) No 178/2002 on general principles and requirements of food law11 (e.g. this may affect certain slimming products); in return, medical devices are excluded from the scope of Regulation 178/2002 (diagnostic probes or cameras, even when introduced orally, are therefore clearly excluded from the food legislation).
With regard to the goods delivered by the Supplier, the Buyer is obliged to strictly comply with all its obligations ensuing from EC Regulation 178/2002 of the European Parliament and the Council of 28 January 2002 (General Food Law) and the legislation based on that.The Buyer shall indemnify the Supplier against all claims from third parties, including government agencies, if and insofar as the Buyer fails to comply strictly with said legislation.
