Remedial Work definition

Remedial Work has the meaning assigned such term in Section 8.10(a).
Remedial Work means any investigation, monitoring, clean-up, containment, remediation, removal, payment of response costs, or restoration work and the preparation and implementation of any closure or other required remedial plans that any governmental agency or political subdivision requires or approves (or could reasonably be expected to require if it was aware of all relevant circumstances concerning the Property), whether by judicial order or otherwise, because of the presence of or suspected presence of Hazardous Substances in, on, under or about the Property or because of any prior Hazardous Substance Activity.
Remedial Work is defined in Section 6.12(f).

  • Concord shall continue to be responsible for any and all payments due and payable to the Province under the Post-1988 Contaminant Remediation Agreement in respect of the completion of any Remedial Work (Post 1988 Contaminants) (as such term is defined in the Post-1988 Contaminant Remediation Agreement) by the Province in respect of, inter alia, the City Sites.

  • StadCo shall be responsible for performing or causing to be performed, and for paying the cost of performing, such corrective or remedial actions (including all investigations, monitoring, etc.) required by Applicable Law to be performed with respect to any Environmental Event or any Hazardous Materials present at, in, on or under the Premises (the “StadCo Remedial Work”); provided, however, under no circumstances shall StadCo’s Remedial Work include the Authority Remedial Work.

  • If it is determined pursuant to an evaluation conducted by the mutually selected independent environmental consultant that remediation of the same is required by this Section 7.9(a)(ii) (Authority Remedial Work) and such remediation qualifies as the Authority Remedial Work, then the Authority shall pay the costs of such evaluation and StadCo shall perform the Authority Remedial Work at the Authority’s cost and expense and with reasonable diligence and in compliance with all Applicable Laws.

Remedial Work. Any investigation, inspection, site monitoring, containment, clean–up, removal, response, corrective action, mitigation, restoration or other remedial work of any kind or nature because of, or in connection with, the current or future presence, suspected presence, Release or threatened Release in or about the air, soil, ground water, surface water or soil vapor at, on, about, under or within all or any portion of any property or Mortgaged Property of any Materials of Environmental Concern, including any action to comply with any applicable Environmental Laws or directives of any Governmental Authority with regard to any Environmental Laws.
Remedial Work has the meaning set forth in Section 5.1(d)(i).
Remedial Work means the repair, modification, replacement, or re- performance of any Work in breach of any condition, warranty, guarantee or covenant of this Contract, including removal and reinstallation of the defective Work or replacement Work, and any other corrective measures required;
