Replacement well definition

Replacement well means a well drilled for the purpose of replacing another well.
Replacement well means a Water Well which is constructed to provide water for the same purpose as the original Water Well and is operating in accordance with any applicable permit from the Department and any applicable rules and regulations of the District and, if the purpose is for irrigation, the Replacement Water Well delivers water to the same Tract of Land served by the original Water Well and (i) replaces a decommissioned Water Well within one hundred eighty (180) days after the decommissioning of the original Water Well, (ii) replaces a Water Well that has not been decommissioned but will not be used after construction of the new Water Well and the original Water Well will be decommissioned within one hundred eighty(180) days after such construction, except that in the case of a Municipal Water Well, the original Municipal Water Well may be used after construction of the new Water Well but shall be decommissioned within one year after completion of the replacement Water Well, or (iii) the original Water Well will continue to be used but will be modified and equipped within one hundred eighty (180) days after such construction of the Replacement Water Well to pump fifty(50) gallons per minute or less and shall be used only for livestock, monitoring, observation, or any other nonconsumptive or de minimis use approved by the District.
Replacement well means a well drilled on a drilling and /or production unit to replace another well which is drilled in the same unit and completed in the same pool.

  • If any present or future income tax laws of the state or states in which any Wellbore, Down-Spaced Well, or Replacement Well is located or any future income tax laws of the United States contain provisions similar to those in Subchapter “K,” Chapter 1, Subtitle “A,” of the Code, under which an election similar to that provided by Section 761 of the Code is permitted, each Party shall make such election as may be permitted or required by such laws.

  • If PSE USA makes a permitted conveyance of interests in a Wellbore, Replacement Well, or Down-Spaced Well, it shall, at Pioneer USA’s request, take such actions as necessary to bind the assignee of such conveyance to this Agreement.

  • Notwithstanding the foregoing, should Participant elect not to participate in such a Replacement Well and GWPC elects to commence such a Replacement Well, Participant shall forfeit all rights in and to such Replacement Well.

  • Participant shall remain responsible for all costs of plugging and abandoning the original Prospect Well, but Participant shall have no obligations or liability with respect to such Replacement Well, and GWPC shall defend, hold harmless and indemnify Participant in connection with same.


More Definitions of Replacement well

Replacement well means a well drilled to replace a Developed Properties Subject Well in order to produce Hydrocarbons intended to be produced from the Developed Properties Subject Well but which were not produced from the Developed Properties Subject Well due to mechanical, technical or similar reasons.
